C-1981-038 TR-52 <br />PAR - mlt <br />13-Jan-2010 <br />Page 2 of 2 <br />Quarterly waste disposal area inspection reports were provided beginning in 1983 by <br />Colorado Westmoreland, Inc., the original permittee of what was then named the Orchard <br />Valley Mine. Coal mine waste continued to be placed at the facility through 1997. In <br />1986, more than 28,000 cubic yards of waste was removed from the pile and hauled to <br />the Western Slope Carbon wash plant. Repair work conducted under TR-7 resulted in the <br />removal of 40,000 cubic yards. The volume of the West Ridge site did not change until <br />an additional 10,000 cubic yards was placed in 2001 and 2002. <br />In 2008, BRL commenced reclamation of the East Mine and the Timber Storage Area. <br />Approximately 7,500 cubic yards of Run-of-Mine material stockpiled at the Timber <br />Storage Area was hauled to a site prepared at the northern end of the West Ridge waste <br />bank for permanent placement in March of 2008. Upon placement of the ROM, the final <br />configuration was achieved. <br />Inspection reports and compaction test results have been provided in accordance with the <br />requirements of Sections 4.09 and 4. 10, documenting the placement of coal mine waste, <br />the covering with non-toxic material, the placement of topsoil and seeding of the area. <br />Section 2.10.2(2)(a) states that, "Inspections may terminate when the coal mine waste <br />ban has been graded, covered in accordance with 4.10.4(4), topsoil has been distributed <br />on the bank in accordance with 4.06.4, and revegetated, or at such a later time as the <br />Division may require." Site inspections conducted by the Division confirm that the <br />slopes and benches of the West Ridge site finished and seeded in prior years are well <br />vegetated and stable. Revegetation of areas disturbed and seeded and mulched in 2008 is <br />less mature, but surfaces appear to be stable with respect to erosion, and no slope <br />instability has been identified. <br />The Division concurs that quarterly inspections of the West Ridge Coal Mine Waste <br />Bank will no longer be required Please submit revised text for the Permit Application <br />Package (pages 23i and/or 24) which reflects the completion of the site and the <br />cessation of inspections. <br />Sincerely, <br />Marcia L.
