Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division received your application for Technical TR-52 to the Bowie No. 1 Mine <br />from J.E. Stover & Associates on 9 October 2009 and determined the application to be <br />Complete for purposes of filing on the 19th of October. The Public Notice appeared in <br />the Delta County Independent on 28 October; proof of publication was received on 5 <br />November 2009. TR-52 proposes to allow the cessation of quarterly inspections of the <br />West Ridge coal mine waste disposal site. <br />Section 4.10 requires that coal mine waste banks be designed, constructed, inspected and <br />maintained in accordance with 4.01.1, 4.09.2, 4. 10, and 4.11; and to prevent combustion. <br />A review of Division records, including the permit application package; quarterly <br />inspection reports; permit correspondence; and Division inspection reports confirms that <br />the West Ridge site has been designed, constructed, inspected and maintained in <br />accordance with the Rules. <br />Initial construction of the pile commenced in the summer of 1983; professional <br />certification was received by the Division on 1 September 1983. In 1989, it was <br />discovered that certain slopes had been constructed steeper than the 211:1 V approved in <br />the design, and that insufficient compaction had been achieved at several locations. <br />Repair of the West Ridge site was approved by TR-7, and accomplished in 1991. <br />Design modifications to the West Ridge CMWB were approved with TR-25 in 1994. <br />The design included the placement of rock drains in the drainages east and west of the <br />northern end of the bank. Construction of the rock drains occurred in September 1996, <br />and certification was provided to the Division in February 1998.
