(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-1987-072 <br />INSPECTION DATE: 16 Dprpmher?009 INSPECTOR'S INITIALS: -DR? <br />OBSERVATIONS <br />This inspection was conducted on 16 December 2009 by David Bird of DRMS. Also present during the <br />inspection was Stephanie Carter of the BLM Canon City office. The operator was contacted but was unable to <br />attend. <br />The Lee No. 2 Placer is a 110(2) operation that mines gold as the only commodity. The total permit area is listed <br />as 1.0 acres. The Division holds a bond in the amount of $1,200 for the operation. The post-mining land use is <br />described as pastureland. There was no activity at the site at the time of the inspection, and although snow cover <br />obscured some of the site features, it appears as though only minimal operations have occurred at the site since <br />the site was permitted. The only equipment on site appears to predate the current operator's activity. The only <br />apparent recent disturbance in the immediate vicinity is a relatively new dirt stockpile near and just outside the <br />western boundary of the permit area that the operator said was placed there by another contractor and is not <br />related to activity on the Lee No. 2 Placer. <br />According to annual reports filed by the operator, and as verified by observations on the ground, there has been <br />no activity at the site since the last Division inspection in 2004. As specified by Rule 1.13.2, if there has been no <br />activity at the site for the past 180 days, the Operator is required to file a notice of Temporary Cessation. If the <br />Operator can provide evidence that there has been activity at the site in the past 180 days, then the notice of <br />Temporary Cessation will not be required. However, if the Operator cannot provide such evidence, then notice of <br />Temporary Cessation must be filed within 90 days of the date of this report, which would be 01 April 2010, <br />accompanied by the required $115 fee. This problem is also described on page 3 of this report. <br />The inspector was unable to locate the signs and markers required by Rule 3.1.12. Rule 3.1.12(1) states that the <br />operator must post a sign at the entrance to the mine site, which shall be clearly visible from the access road, with <br />information as required by Rule 3.1.12(1)(a) through 3.1.12(1)(c). Rule 3.1.12(2) states that the permit boundaries <br />of the affected area must be marked by monuments or other markers that are clearly visible and adequate to <br />delineate such boundaries. Operator has 90 days to provide evidence that these problems have been addressed to <br />meet the requirements of Rule 3.1.12. These problems are also described on page 3 of this report. If the sign and <br />markers are actually present on site, the operator should provide to the Division photographs of the sign and <br />markers. The Division also requests that the Operator provide a map with the locations of the permit boundary <br />markers plotted. <br />The Financial Warranty on file with the Division appears to be inadequate. Recalculation of the Financial <br />Warranty indicates that $2,480 would be required to reclaim the site in the event that processing equipment and <br />an excavated pit, as described in the mining plan, were left on site. The calculations supporting this Financial <br />Warranty increase are attached.
