§2.05 APPLICATION FOR PERMIT FOR SURFACE OR UNDERGROUND MINING

PLANS.
(5) Topsoil
The train loadout, truck scale and stockpile facilities were designed and
constructed using accepted engineering practice. It is believed that vegetation
material was removed prior to placement of embankment material. The roads
and facilities were constructed prior to the enactment of SMCRA and the
Regulations of the Colorado Mined Land Reclamation Board for Coal Mining;
no topsoil was salvaged from beneath the embankment.
The recent addition to the truck scale haul road has followed and future
construction will follow the topsoil handling plan located in Volume I Text,
Section 2.05.3(5).
(5) Overburden
The surface mining activities occurring in the train loadout and stockpile area
are not associated with the removal of overburden to expose a coal seam.
