Mr. Andy Rodriguez, P.E. <br />December 22, 2009 <br />Page 3 <br />The applicant has entered into a long term lease agreement with the City of Aurora <br />( "Aurora ") whereby Aurora will deliver up to 49 acre -feet of fully consumable water to the South <br />Platte River at the confluence of the South Platte River & Sand Creek, just north of Metro <br />Wastewater Treatment Plant. The confluence is located approximately 20 miles upstream of <br />the Baseline Resource Pit. A 0.25 percent per mile transit loss for November through March <br />(5.0 percent overall loss) and a 0.5 percent per mile transit loss for April through October (10.0 <br />percent overall loss) has been accounted for in the replacement schedule. During 2010, 5.65 <br />acre -feet from the Aurora lease will be used to cover the remaining depletions after the <br />Laramie -Fox Hills well pumping. <br />In addition to replacing depletions resulting from this mining operation, the City of Aurora <br />effluent will also be used by the Applicant to replace 20 acre -feet of depletions resulting from <br />operations at the Baseline Resource site in accordance with the C.R.S. 37 -90- 137(11) SWSP <br />approved for Hall -Irwin and 23.3 acre -feet of depletions resulting from operation of the Bestway <br />Concrete Well No. 1 (permit no. 67418 -F), in accordance with the C.R.S. 37 -92- 308(4) SWSP <br />approved for Bestway Concrete. Since the City of Aurora effluent is being used as a <br />replacement source for the three plans, the applicant's accounting for each SWSP must specify <br />the total amount of effluent released and the amount associated with each SWSP. <br />A monthly breakdown of depletions and replacements is shown in attached Table 4. <br />Conditions of Approval <br />I approve the proposed substitute water supply plan in accordance with Section 37 -90- <br />137(11), C.R.S., subject to the following conditions: <br />1. This SWSP shall be valid for the period of January 1, 2010 through December. 31, 2010, <br />unless otherwise revoked, modified, or superceded by decree. If this plan will not be <br />made absolute by a water court action by the plan's expiration date, a renewal request <br />must be submitted to this office with the statutory fee (currently $257) by November 15, <br />2010. ` <br />2. Well permit no. 67585 -F was obtained for the current use. and exposed pond surface <br />area of the gravel pit pond in accordance with §37 -90- 137(2) and (11), C.R.S. <br />3. As required by the condition no. 3 of the previous SWSP approval, the Applicant <br />was required to obtain a new permit to operate well no. 66961 -F for dust <br />suppression purposes approved under this SWSP. The Applicant is hereby <br />notified that a permit application must be _submitted within 30 days of the date of <br />approval of this letter or demonstrate that water for dust control at the site is <br />obtained from a different source. Any application will be evaluated subsequent to <br />approval of this plan. The provisions of §37 -90- 137(2) prohibit the issuance of a <br />permit for a well to be located within 600 feet of any existing well, unless the State <br />Engineer finds that circumstances so warrant after a hearing in accordance with <br />the procedural rules in 2CCR402 -5. The hearing will be waived if you are able to <br />obtain statements from the owners of all wells within 600 feet, verifying that they <br />have no objection to your use of the proposed well. Should a new well permit be <br />denied for reasons of 600 -foot spacing, or any other legitimate reason, approval <br />of this SWSP will be canceled. <br />
