rays <br />IIIlillllllllllllllllllllillllllllllllll EXHIBIT M.1 1 OF 2 <br />338062 3/27/2009 9:27 AM Melanie Woodward <br />1 of 2 RSL 8$11.00 D$0.00 Alamosa County Clerk <br />BEFORE THE BOARD OF COUNTY COMMISSIONERS OF ALAMOSA COUNTY <br />RESOLUTION NO: 2009 -Z-_1 <br />RE: APPLICATION OF AT INVESTMENT FOR A CONDITIONAL USE FOR <br />SAND EXTRACTION AND LAND LEVELING ON A TRACT OF LAND <br />LOCATED IN THE SE' /4 OF SECTION 33, TOWNSHIP 38 NORTH, <br />RANGE 11 EAST, N.M.P.M., IN ALAMOSA COUNTY, COLORADO. <br />Commissioner Wilkinson moved for the adoption of the following Resolution. <br />Commissioner Mestas seconded the motion. <br />WHEREAS, AT Investments has submitted an application for a conditional use <br />review requesting the allowance to remove sand a level the land to ground elevation on <br />the following property: <br />TRACT OF LAND LOCATED IN THE SE '/,% OF SECTION <br />33, TOWNSHIP 38 NORTH, RANGE 11 EAST, N.M.P.M., <br />IN ALAMOSA COUNTY, COLORADO. <br />said property being zoned Rural (RU) District; and <br />WHEREAS, a public hearing was held before the Alamosa County Planning <br />Commission on December 10, 2008, which recommended approval of the application. <br />WHEREAS, a public hearing was held before the Board of County <br />Commissioners on January 13, 2009, <br />WHEREAS, proper notice was provided as required by law; and <br />WHEREAS, there was no opposition to the application; and <br />WHEREAS, the Board of County Commissioners has considered the application, <br />and finds the application meets all requirements of the Alamosa County Zoning <br />Regulations pertaining thereto and that the allowance for sand extraction and ground <br />leveling is permitted as a conditional use for such property; and <br />WHEREAS, the proposed use is consistent with the objectives and purposes of <br />the Alamosa County Zoning Regulations and is also compatible with surrounding land <br />use. <br />IT IS THEREFORE RESOLVED AND ORDERED that the conditional use <br />application for allowance to build a private runway upon the above- described property is <br />hereby granted as a conditional use pursuant to the Alamosa County Zoning <br />Regulations, Section 2.1(B). <br />This fax was received by GFI FAXmaker fax server. <br />
