3) Selenium levels have been in exceedance of the CDPS permit effluent limits in <br />the past two years. <br />Energy Fuels Resources has been monitoring flow in the middle tributary to Lumsden <br />Creek as well as discharge into Dolores River from Lumsden Creek during periods of <br />treatment plant discharge. No stormwater flow has been observed in the middle tributary <br />of Lumsden Creek at the treatment plant or from Lumsden Creek into the Dolores River <br />during periods of treated water discharge. As a result, no water samples have been <br />collected from Dolores River. Energy Fuels will continue to monitor surface water flow <br />at these locations and collect samples as required. <br />Hydrological Monitoring Summary <br />Refer to Table 7 for the hydrological compliance monitoring summary and status for <br />Whirlwind Mine. <br />2 <br />
