Waste Rock <br />Production rates of ore and waste rock are shown in Sections 9 and 10 of the <br />Hydrological Report, respectively. Waste rock grab samples were collected quarterly and <br />were representative of material mined, removed for maintenance, or located on the waste <br />rock dump. The dates and locations of grab samples are as follows: <br />• November 4, 2008 — Four locations on the waste rock dump of recently mined <br />waste rock <br />• March 5 and 6, 2009 — Two random locations on the waste rock dump of recently <br />mined waste rock and two locations in the mine that contain material to be <br />removed for maintenance or further rehabilitation (muck bay and drift) <br />• June 19, 2009 - Four locations in the mine that contain material to be removed for <br />maintenance or further rehabilitation (muck bay and drift) <br />• September 8, 2009 - Four locations on the waste rock dump of uncovered, <br />previously mined waste rock <br />The analytical data for a composite sample of the above referenced grab samples is <br />included in Table 6 along with data from three waste rock samples collected previously <br />for permitting purposes. The analytical data report for the collected sample is included in <br />Appendix A of the report. The data includes analyses for total metals and radionuclides <br />(top portion of the table) and Synthetic Precipitation Leaching Procedure (SPLP) metals <br />and radionuclides (bottom portion of the table). The results indicate that the composite <br />waste rock sample is similar in composition to the waste rock samples collected prior to <br />permit approval. <br />Because the Whirlwind Mine is currently on stand -by status with only maintenance <br />activities being conducted, Energy Fuels will be suspending the quarterly waste rock <br />sample collection until such time that mining operations resume and waste rock is <br />removed from the mine. <br />Sediment Pond <br />The sediment pond has been monitored since its construction in November 2008 in <br />accordance with DRMS stipulations. Although storm events have occurred, none have <br />resulted in stormwater discharge from the pond. As a result, no stormwater samples have <br />been collected from the pond to date. Energy Fuels will continue to monitor the sediment <br />pond for discharge and will collect samples in the event of discharge. <br />Dolores River <br />The Dolores River is required to be monitored for selenium upstream and downstream <br />from the confluence of Lumsden Creek in accordance with BLM stipulations to the mine <br />permit when the following conditions are met: <br />1) The Whirlwind Mine treatment plant is discharging treated water, <br />2) There is continuous flow from the middle tributary of Lumsden Creek to the <br />Dolores River, and <br />3 <br />
