Binns <br />Environmental Protection Specialist II <br />Division of Reclamation, Mining, & Safety <br />1313 Sherman Street, Rm. 215 <br />Denver, CO 80203 <br />Re: Foidel Creek Mine (Permit No. C-1982-056) <br />Technical Revision Application No. 70 (TR-70) 18-Left Mine Water Transfer Pipeline (CHS <br />#56089) <br />Dear Ms. Binns: <br />Thank you for your correspondence dated November 30, 2009 (received by our office on December 3, <br />2009) and the documentation provided regarding the subject project. <br />Following our review of the documentation provided, we concur with your determination that site <br />5RT2819 and isolated find 5RT2820 are both not eligible for the National Register of Historic Places <br />(NR-HP). As no historic properties are located within the area of potential effects (APE), we concur <br />that a finding of no historic properties affected is appropriate for the proposed technical revision <br />(TR-70). <br />Should unidentified archaeological resources be discovered in the course of the project, work must be <br />interrupted until the resources have been evaluated in terms of the National Register of Historic Places <br />eligibility criteria (36 CFR 60.4) in consultation with our office. <br />Thank you for the opportunity to comment.
