III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a complete inspection of the Roadside Portals Mine conducted on November 18, 2009 by <br /> Mike Boulay of the Division of Reclamation, Mining and Safety, Grand Junction Field Office. Tonya <br /> Hammond of Snowcap Coal Company(SCC)was present during the entire inspection. Weather <br /> conditions were sunny and cool. Ground conditions were dry. <br /> Availability of Records <br /> The availability of records was checked on the afternoon of 11/18 at J.E. Stover&Associates offices. <br /> All required records were on file and available for review and no problems were noted with the records <br /> review. See the attached Availability of Records checklist. <br /> Roads <br /> Roads were dry and in good condition. The entire mine site including the 2-West Portals, and the <br /> North and South Portals were all accessible and all locations were inspected. Road ditches and road <br /> culverts were well maintained throughout the various mine site locations and support facility areas. <br /> Hydrolosiic Balance <br /> All site sedimentation ponds were inspected. Sedimentation Ponds 6, 7,8,9,10,11, and 13 and UTL <br /> Ponds No. 1 and 2 were all dry. The C13A#1 Sump was dry. Pond embankments, inlets and discharge <br /> structures were stable at all pond locations and no problems were noted. There has been no recent <br /> measurable precipitation at the mine site. <br /> Processing Waste <br /> The CRDA waste disposal sites were dry and stable, diversions and perimeter ditches appeared <br /> functional. A view of the CRDA-2 waste disposal site from a vantage point on the CRDA-1 pile is <br /> shown in Photograph No. 1. At the time of this inspection SCC was in the process of preparing the <br /> temporary coal mine waste storage area atop the CRDA-1 pile as approved with MR-75. SCC's <br /> general contractor Con-Sy Inc. was working at the site. Approximately 1 acre is being stripped of <br /> cover material and the material is stockpiled on the perimeter of the re-disturbance area. This will <br /> allow for temporary storage of coal mine waste from McClane Canyon Mine and from other ongoing <br /> reclamation activities at the Roadside Mine. On Monday(11/23)Halliburton will begin hauling coal <br /> fines from the UTL area to the temporary storage location. After all the coal waste has been unloaded <br /> on the top of the CRDA-1 pile, it will then be placed and compacted in the road that was left open for <br /> that purpose. The cover material will be replaced on the disturbed area atop the CRDA-1 pile and the <br /> site reseeded. The temporary coal waste storage and handling area is shown in Photograph No. 2 and <br /> the cover material stockpile area is shown in Photograph No. 3. <br />
