III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> General Mine Plan Compliance <br /> • Ventilation Borehole drilling has finished for the 2009 season. All holes permitted with TR-63 were <br /> completed, and the drillers were de-mobilizing their equipment via the Bear Creek Road. <br /> • During construction of the power line for the Bear Creek Fansite, numerous trees were felled. It <br /> appears that salvage of the timber has now been substantially completed. <br /> Revecletation <br /> • The outer slope of the West Valley Coal Refuse Facility is very well vegetated and appears to be <br /> completely stabilized with respect to erosion (Figure 3). Some thistle carcasses, curled over from <br /> having been sprayed,were observed on the upper portion of the slope. <br /> • Newly covered and topsoiled portions of the II West Coal Refuse Facility were scheduled to be <br /> seeded later in the week. <br /> Air Resource Protection <br /> • Due to the weekend storm, roads were damp in many places throughout the permit area. A water <br /> truck was being filled in order to spray down the Elk Creek Haul and Access Road. <br /> Slides & Damage <br /> • No evidence of recent movement of slides in the Elk Creek drainage was observed. <br /> Excess Spoil & Development Waste <br /> • The II West Coal Refuse Facility continues to receive refuse from the Elk Creek workings. <br /> • A cut slope bench had been excavated along the western side of the refuse area, and the top <br /> surface of refuse had been recently compacted (Figure 4). <br /> • The elevation of the refuse has increased to approximately 10 feet above the first bench at Elev. <br /> 6100. Trucks transporting refuse to the pile have continued to utilize the lower West Valley Haul <br /> Road; however, as the height of the fill increases, it will soon become necessary to use the II West <br /> Haul Road. <br /> • Construction of the subsurface drain has proceeded uphill in advance of placement of refuse. <br /> Reclamation Success <br /> • Reclamation of Gob Vent Boreholes is continuing. These sites were not visited during this inspection. <br /> Bear Creek Fansite <br /> • Installation of the fan assembly and housing has been completed (Figure 5), and the fan was <br /> running at partial load. <br /> • The generators and piping required to bleed methane from behind the longwall have been installed <br /> and are protected from the elements with a sloped-roof, open-sided structure (Figure 6). <br /> • The substation has been fenced for security and bermed to comply with Federal SPCC requirements <br /> (Figure 7). <br /> • The flowline of the clean-water diversion ditch (BCCD-1) that follows the back side of the Fansite <br /> pad was stabilized with wattles (Figure 8). A backhoe was in operation at the time of the inspection, <br /> putting finishing touches on a ditch that will direct surface flow from the road side of the pad to the <br /> clean-water diversion ditch. <br /> • OMLLC intends to have construction of the Bear Creek Fansite completed by the end of November. <br /> Elk Creek Mine C-1981-022 17-Nov-2009 <br /> -2- <br />
