III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a Complete Inspection of the Elk Creek Mine conducted by Marcia Talvitie of the Colorado <br /> DRMS beginning at 9:30 a.m. on Tuesday, 17 November 2009. Jim Kiger represented the operator, <br /> Oxbow Mining LLC, during the inspection. The main entrance to the mine was blocked by a unit train <br /> which was in the process of being loaded. Access was accomplished from the east, along the former <br /> SH 133 alignment. Weather conditions were clear and cold. A storm had moved through the area <br /> during the previous weekend. Fresh snow remained in many spots throughout the permit area, <br /> although it had melted from the south-facing slopes. <br /> Availability of Records <br /> • Permit records were available for viewing at the OMLLC office. A completed DRMS Availability of <br /> Records Form is attached to this report. <br /> Roads <br /> • Due to the weekend storm, roads throughout the permit area were damp to muddy. <br /> • Lower reaches of the Bear Creek Road had been surfaced with crushed gravel. The road was <br /> graded,with a ditch established on the uphill side and a berm constructed on the outside. <br /> Hydrologic Balance <br /> • Pond A1, adjacent to the railroad tracks at the mine entrance, retained water at a level too low for <br /> discharge to occur. Banks are not vegetated, but appear to be stable. <br /> • Water was also retained in Pond B,with no discharge occurring. <br /> • Pond C, at the base of the West Valley Coal Refuse Facility,was dry. <br /> • The water level in Pond D had risen somewhat since the October inspection, but was still below the <br /> level of the primary spillway (a corrugated metal standpipe) and no discharge was occurring. <br /> • Pond E, at the base of the II West Coal Refuse Facility,was dry. <br /> • Below the Hubbard Creek Fansite, Pond F was dry. <br /> • The floor of the pond adjacent to the USFS parking area in Hubbard Creek was covered with snow. <br /> • The East Yard Pond had received runoff from the weekend's storm, but the water level was below <br /> the spillway elevation. <br /> • The pond located at Substation No.3 was dry. <br /> • Ditches throughout the Elk Creek Facility were graded and capable of carrying flow as designed. <br /> • Bear Creek, at the Fansite,was dry. No water flowed through the concrete culvert (Figure 1). <br /> Explosives <br /> • Magazines are stored below the impounding structure for Pond D. All four vaults appeared to be <br /> secure and in good condition. Signs were posted. <br /> Support Facilities <br /> • The facility at Substation No. 3 has been dismantled. The fan assembly and substation have been <br /> removed, along with the fence that once surrounded the facility. Only the concrete foundations for <br /> the former substation and fan assembly remain (Figure 2). <br /> • There has been no change at the Hubbard Creek Fansite. Structure removal and reclamation will <br /> likely occur in 2010. <br /> Elk Creek Mine C-1981-022 17-Nov-2009 <br /> -1- <br />
