III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during <br /> the inspection. Comments also describe any enforcement actions taken during the inspection and the <br /> facts or evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Janet Binns of Colorado Division of Reclamation, Mining <br /> and Safety. Brian Watterson of Twentymile Coal Company accompanied the field portion of the <br /> inspection. The Foidel Creek Mine is a large active underground mine. The weather was warm and dry <br /> during the inspection. The operator indicated that the weather has been warm and dry the last several <br /> days. <br /> Roads: Haul Roads and access roads throughout the mine are in relatively good condition. TCC has <br /> cleaned and shaped many of the ditches throughout the facilities area. Ditches around facilities area are <br /> functional and no ditch or drainage failures of the structures were observed around the facilities area. <br /> The water truck was not observed watering roads, but roads were not dusty. <br /> Hydrologic Balance: TCC was not pumping from TORT at the time of the inspection. According to <br /> mine personnel,this location has not been turned back on since pumping ceased in May. TCC is <br /> investigating a long term solution to water treatment from the 1 ORT borehole. Current water handling <br /> found that TCC was Discharging at FCB (site 115). Brian indicated that 7/14 the conductivity of the <br /> Site 115 discharge was approx. 600 µs. Site 115 Flow measured 0.22 on 8" flume. Discharge was <br /> relatively clear. FCVS was pumping to Pit 1. Water was being pumped to the barricade chamber from <br /> 10 RT. <br /> Channeling of the ditch on the Barricade chamber pad has occurred. This appears to be a result of <br /> ground squirrel or marmot burrows. TCC needs to seal this hole, and the animal burrows, and assure <br /> that water flows as designed. <br /> 6MN reservoir is holding runoff water. As-built certification for 6MN Reservoir has not been provided <br /> to DRMS yet. TCC has not yet installed the pumping facilities at the 6MN reservoir. TCC indicated that <br /> once piping and pump installation is complete the As-built certification will be prepared. This <br /> certification will need to be provided to DRMS and on file at the mine. Stabilization seeding is needed <br /> on the outslopes of the 6MN reservoir. <br /> Ponds inspected included Pond F, Pond G, Pond E, C, B, T, D and 6MN pond. Pond D was <br /> discharging, and water was flowing from Pit 1 to Pond D. Pond D discharge measured 0.32 on 12" <br /> flume. The effluent was clear and numerous minnows were swimming in the effluent. Pond B was <br /> discharging clear, estimated tickle of 0.01 on the staff gauge. The oil booms need to be replaced but no <br /> oil sheen was discernable on the water surface. Pond T was discharging at a trickle. <br /> Processing Waste: The RDA 100-year ditch on the north side of the pile has yet to be cleaned. Drainage <br /> still runs out of the rip-rapped channel and down the east slope, but all drainage from the refuse pile still <br /> is directed to Pond D. This ditch needs immediate clean out.
