1111. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />Fish Creek Bore Hole ponds were not discharging to Fish Creek at Site 115. TCC was not pumping to <br />the FCBH ponds nor to FCVS. An excavator was completing repairs to a broken line from the FCVS at <br />the time of the inspection. The Million Gallon tank at the PM Bay was not spilling over. <br />Processing Waste: The refuse pile continues to accept refuse material. Refuse is being placed on the <br />southern end of the pile. Technical Revision No. 67, RDA expansion, was proposed for approval on <br />11/13/2009. The public notice still needs to be published, which shall initiate a public a10 -day public <br />comment period. The culvert on the west haul road access still needs additional clean out at the inlet. <br />Reve etg ation: TCC had a contractor seed disturbed areas throughout the mine site. The seeding was <br />conducted prior to the latest snowstorms. Areas seeded included buried waterline corridors at 6MN to <br />TORT, 6MN Reservoir embankment and laydown areas, 6MN sediment pond south slope, FCBH water <br />line alongside the Fish Creek Borehole access road, and areas alongside Haul Road C where weed <br />control was conducted. TCC needs to seed the repaired portion of Pond D embankment. Seeding now, <br />before additional snow falls, may aid in spring establishment of the seed and may help minimize weeds <br />next growing season. <br />Wildlife: Wildlife was observed adjacent to active mining activities. A fox was observed hunting small <br />prey near the IORT borehole facilities. Three coyote were observed near the Fish Creek Borehole access <br />road. A large herd of Elk, > 50 head were grazing on the slopes south of the main mine facilities. <br />Support Facilities: TCC is contracting the removal of the hydraulic oil contaminated material at 6MN <br />facilities area and at 18RT. Additional disposal of shield emulsion fluid is being contracted. TCC is <br />repairing shields in preparation for the upcoming longwall move which requires draining and <br />replacement of emulsion fluid. <br />18LT Ventilation shaft pad area construction is mostly completed. Water and drilling mud was <br />contained in both cells of the cuttings pit at the time of the inspection. Contractors were preparing for <br />pouring of cement pads and collars around the vent holes. No problems were observed in this area and <br />the project appears to be winding down. <br />Dismantling of one of the fans at the EMD ventilation site has been conducted. This fan will be <br />reassembled at the WMD ventilation site. The concrete foundation at the EMD vent shaft will need to <br />demolished and disposed of. The ventilation shaft will need to be sealed and reclaimed as permitted. <br />The hoist and hoist building at 18RT has been removed. The hoist, heater, and hoist building will be <br />reassembled at the 18LT ventilation site.
