III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Janet Binns of Colorado Division of Reclamation, Mining <br />and Safety. Brian Watterson of Twentymile Coal Company accompanied the inspection. The Foidel <br />Creek Mine is a large active underground mine. The mining operation is in the last panel, LW panel 24 <br />of the Northern Mining District. TCC has not begun its longwall move to the first panel of the Western <br />Mining District (WMD). The weather started clear and cold -15 degrees F, warming to above freezing as <br />the day continued. The mine facilities and roadways were frozen at the onset of the inspection, turning <br />muddy as the day progressed and the roadways thawed. <br />Roads: Haul Roads and access roads throughout the mine are in relatively good condition. TCC has <br />cleaned and shaped many of the ditches throughout the facilities area. Ditches around facilities area are <br />functional and no ditch or drainage failures of the structures were observed around the facilities area. <br />Roadways became muddy during the day as the roads thawed, however, the roads appeared to drain <br />appropriately. <br />The culvert identified in the previous (10/27/2009) along the Fish Creek Bore Hole access road has been <br />cleared. Most of the discharge from the stockpond now flows through this culvert. Some shaping of the <br />ditch is needed to keep all of the discharge directed through the culvert. <br />Hydrologic Balance: <br />TCC was not pumping from TORT at the time of the inspection. TCC has buried the line from the outlet <br />near Routt County Road No. 33 all the way to the TORT pad and pump house. A drilling crew was <br />drilling the 4" dia. piezometer hole at the time of the inspection. Cutting fluids were contained in a mud <br />pit on the site. No fluids were leaving the site. The east end of the ditch collecting runoff from the pad <br />needs to be clearly defined. The piping on the west side of the new IORT pumphouse has been <br />completed. This hole has been backfilled. <br />6MN reservoir is holding a small pool of runoff water and is frozen. TCC has constructed the pump <br />house pad and has poured the concrete foundation for the pumphouse. The pumphouse still needs to be <br />installed and the pump placed. TCC has seeded the 6MN reservoir embankment and laydown areas. <br />Once the pumphouse installation is completed an As -built certification for the 6MN Reservoir needs to <br />be provided to DRMS. <br />The embankment on the 6MN sediment pond has been built up. Neither the spillway, nor the drainage <br />channel have been constructed yet for the 6MN sediment pond. TCC has seeded the slope to the south of <br />the 6MN sediment pond. <br />Ponds inspected included Pond D, Pond G, 6MN reservoir, and 6MN pond. None of these ponds were <br />discharging. Repairs to Pond D embankment and riser have been completed. TCC replaced the entire <br />length of the discharge culvert through the embankment, including under the conveyor. TCC had <br />compacted the repair in the embankment and has had a contracted engineering firm conduct compaction <br />tests on the repaired embankment. TCC will need to resubmit to the Division, an as -built certification <br />for Pond D to document the repairs were conducted in accordance with the approved design. <br />3 of 5 WHITE - File YELLOW - Operator PINK - Specialist <br />
