sediment. There are no proposed highwalls that will be left from the mining <br />operation. <br />(4) All grading will be done within a reasonable time following the <br />mining operations. When mining is completed, grading will begin to create <br />the final contours proposed for the site. <br />(5) There are no known acid producing or toxic materials on the property <br />as a result of the current agriculture use. Any materials of this nature that <br />might be found will not be used in the reclamation plan. If materials of this <br />nature are found on the property, they will be disposed of off-site, according <br />to applicable laws. <br />(6) There are no drill or auger holes that will be a part of this mining <br />operation. No adits or shafts from previous mining operations are known to <br />exist at this site. If a shaft or adit is discovered during this mining operation, <br />it will be closed and sealed in accordance with good engineering practices. <br />(7) The proposed slopes and slope combinations for the reclamation plan <br />are compatible with the configuration of the surrounding conditions and the <br />selected end land use. There will be no lake or pond created by this mining <br />operation. No slopes remaining after the reclamation will be greater than <br />3H:1 V. <br />(8) The reclaimed slopes will allow for agricultural machinery to traverse <br />the area if needed. The slopes will also allow for livestock to easily traverse <br />the area. <br />(9) The operator reserves the option of bringing off-site inert structural <br />fill material for backfilling of any area. If the operator chooses to bring off- <br />site inert fill, the Division will be provided with a 30 day prior Notice. The <br />Notice will include the following (as described in Rule 3.1.5 (9) of the <br />Mined Land Reclamation Rules): <br />A) A narrative that describes the approximate location of the <br />proposed backfilling activity; <br />B) The approximate volume of the inert material to be backfilled; <br />C) A signed affidavit certifying that the material is clean and inert <br />as defined in Rule 1.1(24); <br />D) The approximate dates the proposed activity will commence <br />and end, however, such dates shall not be an enforceable <br />condition;
