III. COMMENTS - COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made
during the inspection. Comments also describe any enforcement actions taken during the inspection
and the facts or evidence supporting the enforcement action.
This was a partial inspection conducted by Kent Gorham of the Colorado Division of
Reclamation, Mining, and Safety (Division) related to the termination of jurisdiction for the
Trinidad Basin Mine, permit # C -81 -048. This former, contour strip operation is bond revoked.
All remaining funds from the bond revocation at this site were spent in 2004 for ditch repairs.
The Division is in the process of terminating jurisdiction of this revoked site. As per Division
policy and in accordance with Rule 3.03.3, the Division may terminate jurisdiction upon a
written determination that all requirements of the Rules and the Act have been successfully
completed and a final decision has been made in accordance with the bond release
procedures of Rule 3.03. Ground conditions on this day were snow - covered and muddy in
places. The weather was partly cloudy and unseasonably warm.
This was a continuation of a previous inspection conducted on September 16, 2009 that was
terminated early due to heavy rain. That inspection terminated after verification and
documentation of the residential land use of the western half of the permit area. Ranchette
properties are part of the Delagua Canyon Ranch development.
