III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete coal inspection conducted by Jason Musick of the Colorado Division of <br />Reclamation, Mining, and Safety (Division) on 12 November 2009. The weather was clear and the <br />mine site was dry during the on- the - ground inspection of the site. Scott Wanstedt of BME <br />accompanied the inspection. <br />The mine is currently operating as permitted. Drilling activities approved under TR -67 were in <br />Progress during the inspection. Deserado Mine continues to longwall in panel 10. <br />attached DRMS Availability of Records. All records were inspected at the Deserado Mine site <br />All mine ID signs required were in place at the time of the inspection. Mine ID signs were located at <br />the intersection of State Highway 64 and Rio Blanco County Road 65, the permit boundary on CR 65, <br />the permit boundary at CR 96, five locations where the permit boundary crosses CR 73, and on the <br />gate entering the Stanley Gordon Area. The mine ID signs include the name of the permittee, the <br />name of the operator, the address of the operator, the identification number of the operator and the <br />MSHA ID number of the operator. <br />Topsoil and subsoil markers were in place at the required locations. These areas are delineated with <br />a PVC post with a sticker noting either topsoil or subsoil. <br />paved Deserado Mine Road was well maintained and in good condition. The haul road from the <br />ilities area to the refuse disposal area stable and displayed good drainage with no problems noted. <br />conveyor corridor road, access roads and light -use roads were in good condition with no <br />iblems noted. All roadside ditches and diversions were functioning and stable at the time of the <br />H I vdroloaic Balance <br />The DP -1 Pond contained a small amount of water with no discharge noted. The pond embankments <br />were stable and well vegetated. The primary spillway is stable with no problems noted. A walkway <br />will be installed to aid in the sampling when discharge occurs. The emergency spillway was stable <br />with no problems noted. <br />Pond PP -1 contained water, although no discharge was noted. PP -1 is a concrete pond and <br />appeared to be stable with no problems noted at the time of the inspection. <br />Pond PP -2 contained water with no discharge noted. Embankments were stable and well vegetated <br />with no problems noted. <br />The fresh water lagoon contained water, although not discharging at the time of the inspection. The <br />lagoon was stable with no problems noted at the time of the inspection. <br />I <br />
