111. COMME14TS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />d�ring the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete coal inspection conducted by Jason Musick of the Colorado Division of <br />Reclamation, Mining, and Safety (Division) on '11 November 2009. The weather was clear and the <br />ground was dry during the inspection of the site. Graham Roberts of TMI accompanied the <br />inspection. <br />Trapper continues to progress with mining in the F -Pit, Z -Pit, and the small area of D -Pit being utilized <br />to Imine the I -seam for the newly acquired truck /loader fleet. Activity in Horse gulch is progressing as <br />permitted under PR -06. <br />Availability of Records <br />I <br />See attached DRMS Availability of Records. All records were inspected at the Trapper Mine site. <br />e ID and Blasting signs were displayed in the locations required. All required information was <br />:)erly displayed at the time of the inspection Topsoil markers and Permit Boundary markers <br />)ected are delineated with a piece of PVC pipe attached to a T -post with either a P for permit <br />ndary or T for topsoil. The topsoil markers and permit boundary markers observed were in good <br />dition and displayed in the appropriate locations with the exception of the following: <br />• The large relocated topsoil pile west of the A -Pit and the two topsoil piles along the south ridge <br />of F -Pit and Z -Pit will require topsoil markers. <br />signs and markers were in compliance with Rules 4.02.2, 4.02.6(3) and 4.02.7 at the time of the <br />oection. <br />haul roads were dry at the time of the inspection. Water trucks were observed along the Ash Pit <br />it road. All haul road side ditches were functioning as permitted at the time of the inspection. No <br />ns of damage or erosion was noted. Access; roads were dry with full access. All access roads <br />)eared to be stable with no damage noted. Pond access roads appeared to have been recently <br />ided and provide good runoff. Road culverts observed were functioning as permitted with no <br />iblems noted. <br />1 Pyeatt, Oak, Middle Flume, East Flume, and Horse ponds contained water with no discharge at <br />time of the inspection. All pond embankments were stable with no problems noted at the time of <br />inspection with the exception of the following. All combination spillways were in compliance at the <br />of the inspection. <br />discharge ditch of the East Pyeatt Ponds mras cleaned out and was stable at the time of the <br />`Middle Flume pond is being prepared for cleanout. The pond is holding a small pool of water and will <br />belcleaned out when equipment becomes available. No problems were noted. <br />
