I will address each item in the order or your letter. I <br />will attached corrected documents for,the file with this letter. <br />The return receipts for the adjoining owner mailing notices and the <br />Proof of Publication for the mine were submitted on,9-25-2009. <br />1. We wish to thank the Colorado Historical Society for their <br />review of the site. It is good to know that we will not <br />disturb any cultural resources when mining. Grand County will <br />most assuredly comply with CRS 24-80 Part 13 if they find any <br />human remains when mining. <br />Exhibit D - Mining Plan (Rule 6.4.4) <br />2. This was a typographical error. The 8 to 20 foot figure is <br />correct. Attached is a revised Page 8 to replace the one in <br />the application packet. <br />3. Thank you for catching this. I seem to have left them off <br />when I revised the map the first time. A corrected Mining <br />Plan Map is attached. <br />4. Grand County Department of Road and Bridge will commit to <br />seeding the topsoil piles if they will remain undisturbed for <br />more than 180 days (6 months). <br />5. I used single stage instead of no staging to describe the <br />amount of disturbed area will be the limit to 20 acres but the <br />20 acres maybe in more than one area within the Permit area. <br />6. There are a no wetlands or water bodies on the site. The <br />Corps of Engineers was contacted prior to placing-anything in <br />the draw just as a precaution. They told Mr. Clark that if <br />there was water for 3 month or more in the draw that a permit <br />would be required to build a crossing thru it. We do not
