III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Corlunents also describe any eniorcelllent actions taken uuriIIg lire inspection and the IkCILS or <br /> evidence supporting the enforcement action. <br /> The operator was doing work on the second and third lifts of the gob pile. On the second lift, subsoil had been <br /> stripped from the outslope on the east end so that the outsiope could be steepened,as approved. Once the east <br /> section is steepened,the subsoil will be put back onto the second lift outslope. This operation will proceed from <br /> east to west until the entire outslope of the second lift is steepened. The operator was also constructing the third <br /> lift.There was positive drainage on me pile. The upland diversion ditch was in place. Surface disturbance <br /> markers were up. <br /> Hubbard Creek Fan Site <br /> As mentioned previously,the Hubbard Creek fan was in operation. The noise level from the fan was not very <br /> high due to noise baffles and the air deflector. The fan was painted green to lessen the visual impact. The upland <br /> diversion ditch was in place and the riprapped section of the ditch was intact. Straw bales were positioned in the <br /> down gradient part of the collection ditch. However,more straw bales need to be positioned across the ditch and <br /> trenched and anchored into the ditch.The disturbed area has not been seeded yet,nor has the fence around the <br /> site been consirucied. The road section nexi io the fan site was dry and in good condition. Silt fence was up <br /> between the road and Hubbard Creek. The mine ID sign was up at the entrance and surface disturbance markers <br /> were up as well. The stream buffer zone signs need to be put back up onto their posts. <br /> Unit Train Loadout <br /> There was no unit train on the Bowie No.2 spur line.There were a few empty and full railcars at the adjacent <br /> Terror Creek Loadout,however. There were no problems with fugitive dust.The spur line bench appeared to be <br /> stable. T lie benlal Vutsiopes weie well vegetated. Sedlnlellt pond J was uty. The pond's pilllla.iy dlscllalge pulllp <br /> was in place and the riprapped emergency spillway was in place. The riprapped ditches leading into pond J were <br /> functional.
