M. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspectioI. Comments also describe any enforceIIlent actions taken during the IIIspectlon and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Joe Dudash of the Colorado DBMS.Bill Bear represented the <br /> operator during the field inspection and records check.The operator is currently iongwail mining in the B-8 <br /> panel and will begin moving the longwall into the B-9 panel by mid November.Longwall mining in the B-9 <br /> panel will begin in December.Installation of the Hubbard Creek fan was completed on Monday and was <br /> operating during the inspection.The arrangement with the West Elk Mine to wash their coal has ended. <br /> Main Mine Site <br /> The access road up to the utility bench was in good shape. The road ditch and outside berm were in place. The <br /> ditch in back of the utility bench had sufficient capacity. The rock catchment berm on the slope above the utility <br /> Oetich was iuliciiouilig properly. There was no evideice U1 the seep to Ule West of the Veitch. TWo rock lldZdl'U <br /> signs were up along the road on the west side of the bench. Surface disturbance markers were up. The topsoil <br /> sign was on the topsoil stockpile. There was a moderate vegetative cover on the topsoil stockpile. <br /> There was a fair volume of stockpiled coal on the D-seam portal bench.No problems were noted with culverts <br /> and ditches on this bench.The material storage areas were neatly organized. Some explosives were being <br /> 1__ _•_ 1 rr_ii n___.r_z_ �•_�. ar i_ r__. fill _ <br /> brought-into the inane to deal N'ltll A cool loll. Jounce 'isturbance nlamerb were up. l.UL art' 1-i11 J1UpeJ were <br /> stable.The bench's outer edge berm was in place.There were no fuel leaks at the fuel facility. <br /> The excess material storage area across the main haul road from the B-seam portal bench was stable.The cut <br /> and fill slopes of the B-seam portal bench were stable as well.There were coal fines that had fallen from the <br /> overhead conveyor up gradient of the B-seam portal bench but the area drains to the sediment pond and the <br /> operator occasionally cleans up the fines.The ditches and culverts in this area were functioning properly. <br /> The main topsoil stockpile was well vegetated. Topsoil signs were up.There were no problems with the material <br /> storage area next to the main topsoil stockpile.The road culvert at the entrance to this area was clear.The paved <br /> main haul road was in good condition. The guard rail and road ditches and culverts were functional. The <br /> downhill conveyor corridor did not exhibit any erosional problems. The wildlife crossover was in place. <br /> The wash plant was operating during the inspection.The cut and fill slopes of this bench were stable and <br /> sediment control structures were in place.There were no problems at the wash plant water tank area. There was <br /> a small volume of coal that was stockpiled on the lower coal stockpile bench. The culverts and ditches at the <br /> mine site entrance area were functioning properly. There was no problem with fugitive dust. There was a small <br /> volume of water in pond B.The pond spillways were functional and the float was on the primary discharge pipe. <br /> The mine id sign was up at the pump house.The straw bales were in place next to the Deer Trail Ditch. <br /> Coal Waste(Gob) Stockpiles <br /> The gob pile haul road was dry and in good condition.The road ditch and berm were in place. There were no <br /> problems with the material storage areas along the road. The operator recently cleaned out pond C.The float <br /> was on the primary discharge hose.The water level of pond C was near the primary discharge tube level,but <br /> there was no discharge.The pond embankment was stable.There was the usual small seep on the opposite side <br /> of the drainage away from the pond C emergency spillway. The water level in pond D was also near the primary <br /> discharge level. There was no discharge from the pond. Culverts in this area were clear,although the outlet of <br /> the road culvert at the gob pile entrance could use cleaning soon. Ditches in the area had sufficient capacity. <br /> 1 <br />
