III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Kent Gorham and Dan Hernandez of the <br /> Colorado Division of Reclamation, Mining, and Safety (Division). This mine is in permanent <br /> cessation and reclamation of most areas is complete. Ground conditions on this day were <br /> muddy due to recent precipitation. The weather on this day was cloudy but mild. Upon <br /> arrival, the mine entrance gate along County Road 92 was found locked. We unlocked the <br /> gate and closed and locked the gate after entering. Upon leaving the gate was found <br /> unlocked and was left closed but unlocked after leaving the site. A red van with numerous <br /> occupants was seen during the inspection at the end of County Road 92 entering the Newlin <br /> Creek area. <br /> Signs and Markers <br /> The operator uses orange t-posts to mark the disturbed area. Generally, the operator has <br /> done an excellent job of marking the disturbed and/or reclaimed area. We inspected <br /> markers in the reclaimed explosives storage area, near the former rock dust tank location, <br /> along the road to the substation, around the substation, and on the west, north, and east <br /> sides of the RDA. It appears that someone may have removed markers along the short spur <br /> of road (shown below) at the NW corner of the RDA near well MW-10 and used them to <br /> repair the adjacent fenceline to the north, as markers along the fenceline do not correspond <br /> to a disturbed boundary of any kind. <br /> Road spur at NW corner of RDA <br /> 3 <br />
