III. COMMENTS - COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made
during the inspection. Comments also describe any enforcement actions taken during the inspection
and the facts or evidence supporting the enforcement action.
This was a partial inspection conducted by Kent Gorham and Dan Hernandez of the
Colorado Division of Reclamation, Mining, and Safety (Division). This mine is in permanent
cessation and reclamation of most areas is complete. Ground conditions on this day were
muddy due to recent precipitation. The weather on this day was cloudy but mild. Upon
arrival, the mine entrance gate along County Road 92 was found locked. We unlocked the
gate and closed and locked the gate after entering. Upon leaving the gate was found
unlocked and was left closed but unlocked after leaving the site. A red van with numerous
occupants was seen during the inspection at the end of County Road 92 entering the Newlin
Creek area.
Signs and Markers
The operator uses orange t-posts to mark the disturbed area. Generally, the operator has
done an excellent job of marking the disturbed and/or reclaimed area. We inspected
markers in the reclaimed explosives storage area, near the former rock dust tank location,
along the road to the substation, around the substation, and on the west, north, and east
sides of the RDA. It appears that someone may have removed markers along the short spur
of road (shown below) at the NW corner of the RDA near well MW-10 and used them to
repair the adjacent fenceline to the north, as markers along the fenceline do not correspond
to a disturbed boundary of any kind.
Road spur at NW corner of RDA
3
