INTRODUCTION
SCC will apply for release of the bond held by the Colorado Division of Reclamation, Mining and Safety. The first
step in obtaining bond release is to obtain a letter from the landowner consenting to the proposed postmine
reclamation and land use plan. The second step is to obtain a letter for the affected surface owner requesting that
identified features/structures (specifically roads) be left as permanent. These steps are in accordance with the
Colorado Mined Land Board Regulations for Coal Mining.
• Rule 2.05.5(11(bl, the postrnining land use description shall be accompanied by a copy of the comments concerning the pro
posed use
by the legal or equitable owner of record of the surface of the proposed permit area and the State and localgovernment agencies which
would have to initiate, implement, approve, or authorise the proposed use of the land following reclamation.
• Rule 4.03. U40. all haul roads shall be removed and the land affected reclaimed in accordance with the requirements of 4.03.1(7)
unless.
(i) Retention of the road is approved as part of the approved postmining land use and the road complies with all applicable
performance standards; and
(ii) The landowner requests to the Division in wntin& that the mad or certain parts thereof are to be left open for further use.
The landowner letters are contained in this attachment within Appendix 20-1.1, Landowner Letters.
PERMANENT FEATURES/STRUCTURES
The features and structures to be left permanent include the following
• Access roads
• Light use roads
• Culverts
• Water well
• Power line and substation
• Fenced shrub plots
• Sediment ponds
• Stock ponds
• Miscellaneous boundary and grazing fences
Rationale, justification, and documentation are provided in the following discussions to demonstrate compliance
with the approved reclamation and land use plan.
Access Roads
Exhibit 20-2, Post Mining Topography, shows the locations of these roads. The road profiles and cross-sections are
included in Tab 20 as Exhibit 20-3, Post Mine Road Profiles.
Road "A"
Rationale: This road will provide landowner access to otherwise inaccessible individual properties within and
adjacent to the Yoast reclamation area following final bond release. SCC will use this road prior to final bond
release as access for maintenance and monitoring.
Justification: Without this road some individual properties would be "land-locked" with no readily available access.
Landowner request letters are contained in Appendix 20-1.1 of this attachment. A recorded right-of-way agreement
between applicable landowners is contained in Tab 3, Adjudication File.
Documentation: The postmine land use calls for a 20 foot wide limited access road to remain inplace using the
approximate original haul road centerline. This road is approximately 3.05 miles in length (16,100 feet). The edges
MR-29 20-1.1 6/09
