Cattany <br />5731 State Highway 13 Division Director <br />Meeker, CO 81641 Natural Resource Trustee <br />Re: Colowyo Mine C-1981-019 <br />Incompleteness Letter - Technical Revision 83 <br />Dear Ms. Sekulski-Barton: <br />The Colorado Division of Reclamation, Mining and Safety (Division) has received the <br />Colowyo Coal Company, LP's (Colowyo) 23 October 2009 submittal of Technical <br />Revision 83 - North Taylor PMT Change and Ditch Realignment. The revision was <br />received by the Division on 26 October 2009. The Division's initial review indicates that <br />all items required by Rule 2.08.5(4) have not been submitted. Based on this review, the <br />Technical Revision 83 (TR-83) application is deemed incomplete for the purposes of <br />filing as of 5 November 2009. The Division will review the revision again for <br />completeness upon receipt of the required materials. <br />General Background <br />Technical Revision-83 proposes the redesign and realignment of the permanent, post- <br />mining drainage channels in the West Pit, East Taylor watershed. In addition to these <br />channel design and location changes, minor changes to the post-mining topography in the <br />North Taylor area of the watershed are proposed. The submittal of Technical Revision <br />83 included a cover letter, a proposed public notice, a change sheet (for tracking permit <br />page and map changes) and revised maps 19, 19B, 20, 33A and 41. The following is a <br />list of the proposed changes contained in Technical Revision 83, based on the <br />information provided. <br />East Taylor Ditch - Colowyo is proposing to shorten the East Taylor Ditch by <br />approximately 750 feet (from its currently approved length of approximately 15,025 feet <br />to a proposed length of approximately 14,275 feet). The newly proposed East Taylor <br />Ditch will begin in the same location but it will intercept the Taylor Tributary Ditch at <br />approximately station 10+00 (as opposed to its currently approved intercept point at <br />approximately station 3+00). Colowyo is also proposing to change the configuration of <br />the lower portion of the East Taylor Ditch from approximately station 50+00 to station <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
