structure cleaning, the filling of two subsidence holes at the Oakey Plaza area and the
backfilling of an isolated mine opening. BTUEC also did spot-spraying of weeds on the
site. BTUEC has reported that their concentrated tamarisk treatment program, completed
in 2006, has been effective and no tamarisk has returned to the site. Finally, the mine's
program to eliminate the ground squirrel infestation that had been a problem on the east
side of the mine has been successful in significantly reducing their population.
The Division continues to inspect the site on a quarterly basis and has written reports
regarding the reclamation and maintenance activities at the Eagle Mine Complex. The
statements made in the 2008 Annual Reclamation Report correlate with what the Division
has observed on the ground. More detailed information can be found in the Division's
quarterly inspection reports.
1. Please provide the Division with a table of the seed mix used on the 2008
reclamation and please provide copies of the seed tags used for the 2008 seeding.
2. Although BTUEC regraded the disturbed areas associated with the building
demolition and solid waste disposal area in 2008, no backfilling and regrading
acres or topsoil replacement acres were included on the Division's Annual
Reclamation Report form attached to the 2008 Annual Reclamation Report.
BTUEC did include 9.4 acres of reseeding. Please correct the Division's Annual
Reclamation Report form as necessary or explain why these regraded and
topsoiled acres were not included on the form.
3. BTUEC has indicated that several of the demolished buildings had "minor
occurrences of asbestos". BTUEC states that the asbestos was removed by a
licensed asbestos removal firm. Please provide the Division with documentation
that the asbestos was, in fact, removed from the site by a licensed asbestos
removal firm.
This concludes the Division's review of the 2008 Annual Reclamation Report for the
Eagle Mine Complex. Please contact me at (303) 866-3456 X8145 if you have any
questions or comments.
Sincerely,
James R. Stark
Environmental Protection Specialist
cc: Sandy Brown
