Cattany <br />p <br />p Division Director <br />29515 RCR 27 Natural Resource Trustee <br />Oak Creek, CO 80467 <br />Re: Eagle 5 & 9 Mines C-1981-044 <br />2008 Annual Reclamation Report <br />Dear Mr. Nettleton: <br />The Division has received the BTU Empire Corporation's (BTUEC) submittal of the <br />2008 Annual Reclamation Report for the Eagle Mine Complex. The report was dated 14 <br />April 2009 and received by the Division on 16 April 2009. Thank you for your timely <br />submittal of this report. The Eagle Mine Complex is currently in Temporary Cessation. <br />There was, however a good deal of reclamation work that was performed during the 2008 <br />reporting year. Based on the Division's review of the Eagle Mine Complex's 2008 <br />Annual Reclamation Report, The Division has the following comments and questions. <br />BTUEC had previously permitted a solid waste disposal area on the east side of Colorado <br />Highway 13 for the disposal of demolition related debris from the mine site Technical <br />Revision 34, approved on 16 November 2007). During the spring of 2008 BTUEC <br />completed reclamation of the No. 9 Warehouse, Oakey Plaza, Brazell-Simms Building, <br />Laboratory Trailer, Lab Sample Storage Building, Bathhouse, Compressor House, Oakey <br />Plaza Well House, Guard Shack and Warehouse Fencing, Brazell-Simms Well House, <br />Old Carpenter Shop and a Shed near the Wise Hill Portal. All of the debris was <br />transported to and buried at the approved solid waste disposal area. <br />In conjunction with the demolition work listed above, BTUEC also regraded all of the <br />disturbed areas associated with the demolished buildings and reestablished positive <br />drainage. Following the regarding work, these areas had the topsoil replaced and they <br />were reseeded with the approved seed mix. BTUEC also backfilled and regraded the <br />approved solid waste disposal area, replaced topsoil and reseeded the area. In total, <br />BTUEC reseeded 9.4 acres of land. <br />In addition to the demolition work, backfilling and regrading, topsoil replacement and <br />reseeding, BTUEC performed site maintenance as needed.
