The Foidel Creek permit is in compliance with all rules pertaining to haul roads, access roads and light <br />use roads. <br />H. Support Facilities <br />Support facility discussion begins on pages 2.05-17.1 to 2.05-65.5.6a of Vol. I and is also discussed <br />under section 2.05-4 to 2.05-6 of Vol. VII. Maps 15, Vol. IX and Maps 24 and 26 of Vol. V-A depict <br />the facilities as described. <br />The Division finds the support facilities in compliance with Rule 4.04. <br />III. Hydrologic Balance <br />A. Water Quality Standards and Effluent Limitations <br />The Division proposes to grant small area exemptions from use of sediment ponds due to the <br />limited size of the areas and due to the fact that ponds and treatment facilities are not necessary <br />for the drainage to meet the effluent limitations of Rule 4.05.2 and applicable State and <br />Federal water quality standards for receiving streams and also due to the fact that no mixing of <br />surface drainage with a discharge from underground workings will occur. Discussions of the <br />approved alternate sediment control locations are located on pages 2.05-82 through 84.7 in the <br />PAP. No new alternate sediment control areas are proposed or approved with the Permit <br />Revision. <br />B. Surface and Ground Water Monitoring <br />The applicant will conduct monitoring of ground water in a manner approved by the Division. <br />The ground water monitoring plan can be found in Exhibit 14, Vol. II-B of the permit <br />document (4.05.13(1)). <br />The applicant will conduct monitoring of surface water in a manner approved by the Division. <br />The surface water monitoring plan can be found in Exhibit 14, Vol. II-B of the permit <br />document. NPDES monitoring is conducted under permits CO-0027154 (surface facilities <br />area), CO-0042161 (Fish Creek Borehole), CO-0036684 (Fish Creek Tipple), COG-850048 <br />(TORT), COG-0072758 and CO-0072272 (6MN sediment pond). <br />The Division has reviewed the surface and groundwater monitoring plans as part of the revision process. <br />These monitoring plans are adequate to allow identification of impacts if any should develop (4.05.13(2)). <br />IV. Topsoil <br />Replaced soils that were stockpiled will be chisel plowed in addition to contour furrowed. These soils will <br />be drill seeded as soon as practicable following topsoil replacement. Stockpiled topsoil not utilized at <br />Energy Mine No. 3 has been transferred to the Foidel Creek permit for distribution at the Fish Creek Tipple. <br />An alternative treatment to eliminate slippage surfaces, relieve compaction, and provide for root penetration <br />is approved. This treatment will consist of chisel plowing (4.06.4(1)). No new surface disturbance is <br />proposed with this Permit Revision. Therefore, no new topsoil stockpile will be created with approval of this <br />Permit Revision. <br />20
