DRMS Response #2, M-1980-146, 29 October 2009, Page 2 <br />will require county and/or municipal review and approval based on regulations in <br />effect at the time the area is converted (in part or whole) from mining to other uses. <br />The trails/roads as shown on BLM land are the only ones currently identified by BLM <br />as permanent; although BLM may add additional trails to their master plan in the <br />future, we cannot identify these, nor the drainage systems required to support them. <br />The four road segments identified on the map will be built to county specifications; <br />therefore (as indicated on the map and elaborated in the revised map), standard storm <br />water controls will be installed both for construction and as permanent features, <br />including: bar ditches (swales), culverts (if needed), spreader dams, rock-check dams, <br />sediment controls (such as straw bales, silt fence, or erosion control logs), and <br />armoring of drainage ways and discharge points, in particular until vegetation is <br />established. The precise location of many of these controls cannot be shown as the <br />location will change as work proceeds, however, many of these details are shown in <br />the Geotechnical Stability Exhibit information provided as requested (see below). <br />2. The other items identified have been added to all eight maps of Exhibit F, as was <br />done in Exhibit C. <br />Exhibit N, Right to Enter, Rule 6.4.14. <br />1. The new agreement for the Gilleland properties is attached. The BLM has been <br />requested to provide the documents as requested, and these will be sent under <br />separate cover when provided. The mineral contract is attached. <br />2. This mineral contract covers indemnity for BLM-owned structures (including fencing <br />and any improvements on the bike trail and roads/trails), just as previous leases have <br />(See Exhibit S). <br />Exhibit R, Prof of Filing Notice with Clerk and Recorder, Rule 6.4.18. <br />1. This letter has been filed with the County, and the receipt is attached. <br />2. Is there any requirement to file these with the local conservation district or other <br />agencies? <br />Exhibit S, Significant Manmade Structures, Rule 6.4.19. <br />1. All houses within 200 feet of affected land are owned by the various Gilleland <br />companies as indicated; a new agreement is attached to cover these and related <br />improvements. This agreement fulfills requirements of both Exhibit N and S. <br />2. The pipelines and wells located within 200 feet of the amendment affected lands are <br />owned by the same entities as those already within 200 feet of the existing affected <br />lands; therefore the existing agreements remain in effect and apply to the additional <br />portions of the same structures. <br />3. The utilities located along the "frontage road" are located within 200 feet of affected <br />land in the existing permit boundaries, and although additional portions of these <br />utilities are located within 200 feet of affected land, the existing agreements remain in <br />effect and apply to the additional segments of utilities. <br />4. CDOT is indemnified by provisions and conditions of the current access permit <br />504061, issued in 2004 for the existing entrance. While a new permit is being <br />negotiated (due to the new interchange), the conditions cannot be finalized but can be <br />presumed to contain the same conditions regarding damage to the CDOT-owned <br />structures. <br />Geotechnical Stability Exhibit, Rule 6.4.20. <br />1.
