6.3.7 Exhibit G - Source of Legal Right-to-Enter <br />22. Page 3 of the permit application lists the owner of the surface of the affected land as Aniceta <br />Lucero. However, the deed that was submitted under Exhibit G lists the owner of the affected <br />land as Aniceto Lucero. Please clarify this discrepancy and make any necessary changes to <br />the permit application. <br />6.3.8 Exhibit H - Municpalities Within a Two-mile Radius <br />No comment. <br />6.3.9 Exhibit I - Proof of Filing with County Clerk <br />No comment. <br />6.3.10 Exhibit J - Proof of Mailing of Notices to Board of County Commissioners and Soil <br />Conservation District <br />No comment. <br />6.3.12 Exhibit L - Permanent Man-Made Structures <br />No comment. <br />6.5 Geotechnical Stability Report <br />23. The applicant has submitted a structural engineering analysis from Merritt LS, L.L.C., which <br />was submitted under the active Special 111 Reclamation Permit, File No. M-2007-080. <br />Please confirm that any use of explosives under the 110 Reclamation Permit will adhere to <br />the blasting plan outlined under the Special 111 Reclamation Permit. <br />24. The applicant has submitted a letter dated December 20, 2007, which states the applicant will <br />incorporate the comments from the Division's review of the structural engineering analysis <br />into the geotechnical stability exhibit. Please incorporate the Division's comments into the <br />Mining Plan. A copy of the Division's review of the structural engineering analysis has been <br />enclosed. <br />25. In the Division's review of the structural engineering analysis submitted under the active <br />Special 111 Reclamation Permit, the applicant was instructed to conduct a pre-blast survey of <br />the fences, farm road, pond and irrigation pump, and sprinkler. The pre-blast survey was to <br />be completed prior to initiation of blasting in the pit. The Division could not find any record <br />of a pre-blast survey in the permit file. The Division will make it a permit requirement to <br />conduct a pre-blast survey of the above structures. Blasting will not be allowed under the 110 <br />Reclamation Permit until the applicant has provided the Division with the pre-blast survey.
