III.COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during <br /> the inspection. Comments also describe any enforcement actions taken during the inspection and the <br /> facts or evidence supporting the enforcement action. <br /> Pond D has been pumped down to allow repairs to the riser. TCC identified a soft spot in the <br /> embankment adjacent to the primary discharge structure during a routine pond self inspection. TCC <br /> immediately notified MSHA and pumped the pool of water to Pit 1 to allow repairs to be conducted. <br /> TCC is trenching the pipe and replacing it. Pit 1 water is being pumped to Pond E. Pond E was not <br /> discharging at the time of the inspection. <br /> Pond B was discharging, clear, at 0.1 on the staff gauge. The oil booms at the weir need to be replaced, <br /> but oil booms in the pond appear functional with no oil sheen visible on Pond B water. The sump at <br /> BOB has filled with sediment. Washdown water is flowing over the sump and through the eastern <br /> culvert to Pond B. BOB sump needs to be cleaned out. <br /> TCC was resetting a pump at the Fish Creek North borehole. TCC was pumping from FCVS to Pit 1. <br /> No discharge was occurring at Site 115. TCC personnel said that as of 10/22 freeboard at FCVS was <br /> 40.83 ft. <br /> Processing Waste: The haul road on the RDA is well graded, side ditches shaped and runoff off the pile <br /> is directed to and staying in the appropriate ditches. TCC has dug out the inlet and outlet of the four 18" <br /> dia. culverts in ditch RDA-2 under the RDA haul road with an excavator. Crew is in the process of <br /> flushing these culverts with a pressure hose. TCC has submitted TR67 for a large expansion of the <br /> existing refuse pile. This revision continues to be under review. TCC continues to place coal waste on <br /> the RDA. End dump piles are drying on the surface of the pile. <br /> Revegetation: TCC conducts regular weed control throughout the mine. TCC conducted weed control <br /> for Canada thistle (Cirsium arvense) this fall. <br /> Support Facilities: TCC's clean up the hydraulic oil spill at 6MN facilities area, TCC has sampled the <br /> soil and found it contained hydrocarbons. TCC will of dispose this material at the County landfill. TCC <br /> will need to find appropriate material to backfill the hole. Rock dust has been cleaned up at this 6MN <br /> location and is not experiencing further rock dust spilling. <br /> The emergency overflow sump south of the Wash Plants 1 & 2 had dried up. TCC has pumped excess <br /> fluid from the 18LT drilling operation into this sump and is allowing this to dry. <br /> TCC is in the process of dismantling one of the fans at EMD vent fan area and move it to the 18LT <br /> boreholes. <br /> Barricade chamber ditch needs repair of burrow hole at the NW corner of the pad area. <br /> 4 of 7 WHITE- File YELLOW-Operator PINK-Specialist <br />
