III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during <br /> the inspection. Comments also describe any enforcement actions taken during the inspection and the <br /> facts or evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Janet Binns of Colorado Division of Reclamation, Mining <br /> and Safety. Brian Watterson of Twentymile Coal Company accompanied the field portion of the <br /> inspection. The Foidel Creek Mine is a large active underground mine. A winter storm moved into the <br /> area during the inspection. Snow and high winds moved through during the inspection. The ground was <br /> dry at the outset of the inspection, with 1-2 inches of snow falling by the second day of the inspection. <br /> The operation is mining NMD longwall panel 24. The panel is nearing its end and the longwall is <br /> scheduled to move to the Western Mining district before long. The operator provided the inspector with <br /> a copy of PR8 adequacy responses. TCC also provided the inspector with a copy of Routt County <br /> Special Use agreement PP2009-008. <br /> Records: Records were checked at the mine office. Records form is attached to this report. <br /> Roads: Haul Roads and access roads throughout the mine are in good condition. TCC has cleaned and <br /> shaped many of the ditches throughout the facilities area. Shaping of ditches at the Truck Loadout looks <br /> like runoff will be routed to Pond C as appropriate and reducing the amount of runoff to Pond B area. <br /> Access roads within the facilities area and outlying access roads have been graded prior to winter <br /> weather. <br /> The culvert under FCBH access road by the stock pond needs clean out to direct discharge from the <br /> stockpond into appropriate ditch. <br /> Hydrologic Balance: TCC was not pumping from I ORT at the time of the inspection. The CPDS permit <br /> for the IORT discharge is COG-850048, which expired 9/1/2009. TCC will need to obtain a discharge <br /> permit from the CPDHE prior to any renewed discharge from this site. <br /> TCC personnel were installing piping to the 1 ORT pumping system at the time of this inspection. The <br /> new pumphouse has been installed. <br /> 6MN reservoir continues to hold a shallow pool of water. This pool is from runoff and precipitation. No <br /> pumping into the reservoir has occurred. TCC was in the process of constructing the pad for pumping <br /> facilities at the 6MN reservoir. Once piping and pump installation is complete the As-built certification <br /> will be prepared. This certification will need to be provided to DRMS and on file at the mine. TCC was <br /> in the process of tracking the embankment to reduce surficial cracks from wetting/drying action of the <br /> clayey surface material. TCC stated that they have a contractor scheduled to seed the embankment this <br /> fall. <br /> 6MN sediment pond has not had the discharge spillway and channel constructed yet. <br /> Ponds inspected included Pond B, Pond C, Pond D, Pond E, Pond F, Pond G, Pond T, 6MN Reservoir <br /> and 6MN pond.
