///. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during <br /> the inspection. Comments also describe any enforcement actions taken during the inspection and the <br /> facts or evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Tom Kaldenbach of DRMS. Ryan Sweetwood of <br /> Mountain Coal Company represented the operator. <br /> Photographs taken during the inspection are attached to the end of this report. With the operator's <br /> consent, this report was issued from the Denver office of DRMS. <br /> The longwall was active more than half of the way through E-Seam Panel 1. The mine was preparing <br /> for a production shutdown that is to occur during the next few days following this inspection while the <br /> direction of ventilation is reversed in the workings. The ground was dry. <br /> Availability of Records <br /> All required records were on file in the mine office(see attached list). <br /> Signs and Markers <br /> Mine i.d. signs were properly displayed at the two entrances on Highway 133 and at the Corrals staging <br /> area. Topsoil markers and affected area boundary markers were properly displayed in all areas <br /> inspected, including: the main surface facilities area, Sylvester Gulch, the Deer Creek Shaft site, <br /> Monument Dam borrow area, and the Corrals staging area. Stream buffer markers were in place in <br /> Sylvester Gulch and next to the North Fork of the Gunnison River along the northern perimeter of the <br /> main facilities area. <br /> Roads <br /> Road surfaces were in good condition in all areas inspected. <br /> Hydrologic Balance <br /> The following sediment control ponds contained low levels of water and were not discharging: MB-1, <br /> MB-2R(CDPS outfall 004), MB-3 (CDPS outfall 005), SG-1 (CDPS outfall 014), and MB-4 (CDPS <br /> outfall 008). The embankments and inslopes of these five ponds appeared in good condition. The <br /> discharge structures of SG-1 was inspected and appeared to be in good shape. <br /> No discharge was occurring at the mine water discharge site in Sylvester Gulch(CDPS outfall 017). <br /> 3 <br />
