Prior to the discharge of any effluent to State Waters, the <br />applicant shall apply for and obtain an NPDES from the <br />Colorado Department of Health, Water Quality Control <br />Division. Any existing permit shall be amended as required. <br />8. The maximum permissible noise level shall not exceed limits <br />as set forth by the applicable State Statutes. <br />9. To provide a buffer, the -area -south of the asphalt plant in <br />Phase 11 shall not be extracted ar used for any mining <br />activity. <br />1D. The operator shall maintain the approved dust abatement <br />program. <br />11. "No Trespassing" signs shall be posted on the perimeter fence <br />and maintained to c].early-identif-y the-boundaries-of - <br />Speciml Review -site. <br />12. All water used in the mining operation shall -be permitted or <br />decreed for commercial or industrial uses. <br />13. No excavation shall be permitted within 50 feet of the Cache <br />la 1'oudre River and within 10 feet of all other boundary <br />lines. Access to the operation will be as shown on the <br />Special Review plat. <br />14. The operation :shall be a wet-pit operation. Crushing <br />.equipment will-be required on the site. <br />15. Hours of operation shall be from 6:D0 a.m. to 10:00 p.m., or <br />longer _as the Planning Commission may Specify. <br />1-6. Fencing, where required, shall be standard chain link with <br />three top strands of barbed wire. Fencing shall be a minimum <br />cf 6 feet high. <br />17. -Topsoil shall be stockpiled on the site. Care will be taken <br />to prevent blowing of topsoil from the site. No pollution of <br />the aquifer due to silt will be permitted. <br />18. -An earthen dike for flood prevention shall be .formed along <br />the north and west property lines or river. <br />19. All construction on the property shall be in accordance with <br />the requirements of the Weld County Building Code Ordinance. <br />87140D
