Banks and Gesso LLC <br />Introduction <br />All-Rite Paving & Redi-Mix, Inc. is submitting this application to the Colorado Mined Land <br />Reclamation Board for. a Regular Operations (112) Reclamation Permit to operate a <br />sand and gravel mine. <br />The proposed operation is called the Proctor Pit and will be fifty one (51) acres in size. <br />Of that permit area, approximately 45.5 acres are proposed as the -potential affected <br />area to recover construction materials. Exhibit D states that the pit will be operated <br />intermittently and that inert material will be imported into the site. There are no water <br />wells or water supply ditches on or affecting the subject property. <br />A 111 Special Operations Reclamation Permit (No.M-2004-055) exists on 29.9 acres of <br />the subject 51 acres and a $75,000 financial warranty remains in place. This 111 <br />Permit supplied materials for a CDOT project. We request that this Special Operations <br />Permit be eliminated and replaced by this new Regular (112) Operation Permit with a <br />new financial warranty. The remaining 20.1 acres of the Proctor Pit site is rangeland. <br />Dwight E. and Julie A. Proctor are the owners of the subject property and All-Rite Paving <br />& Redi-Mix, Inc. has an authorization to mine.on the property. <br />According to the plans submitted as part of this 112 Permit application, the Proctor Pit <br />would be mined progressing generally from the north to the south of the site. <br />Reclamation will occur concurrently as the mining progresses. . <br />On December 16, 2008, the DRMS performed an inspection of the site. The following <br />problems and corrective actions were recommended by the DRMS: <br />• The permit boundary markers are not adequate in number to delineate the permit <br />boundary. <br />o Corrective Action: Place boundary markers of sufficient number and size <br />around the current approved permit boundary. <br />• The operator is not following the current approved mining and reclamation plan in <br />regards to the method of mining and the procedure for topsoil salvaging and <br />stockpiling. <br />o Corrective Action: The operator will need to submit a Technical Revision and <br />required fee to change the current approved mine plan for a vertical highwall <br />and topsoil stockpiling. <br />All-Rite Paving & Redi-Mix, Inc. 09002 <br />Proctor Pit, 2 July, 2009
