III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a partial coal inspection conducted by Jason Musick of the Colorado Division of <br /> Reclamation, Mining, and Safety(Division) on 06 October 2009. The weather was clear and the <br /> ground was wet during the inspection of the site. Graham Roberts of TMI accompanied the <br /> inspection. <br /> Trapper continues to progress with mining in the F-Pit and Z-Pit. Activity in Horse gulch is <br /> progressing as permitted under TR-103 and TR-105. The small area of D-Pit is being utilized for the <br /> newly acquired truck/loader fleet. <br /> Roads <br /> All haul roads were wet at the time of the inspection. All haul road side ditches were functioning as <br /> permitted at the time of the inspection. Adequate runoff was noted with no signs of damage or <br /> erosion. Access roads were wet with full access. All access roads appeared to be stable with no <br /> damage noted. Pond access roads appeared to have been recently graded and provide good runoff. <br /> Road culverts observed were functioning as permitted with no problems noted. <br /> Hydrologic Balance <br /> Discharging ponds were being monitored by Graham Roberts of TMI during this inspection. Three <br /> ponds were discharging during the inspection. <br /> • No Name was stable with no problems noted. No Name contained water and had a discharge <br /> rate of .16 a pH of 8.4 at 11 degrees and 2920 conductivity. <br /> • Johnson contained water with discharge at .04 and pH at 8.7 and 4100 conductivity. <br /> • East Pyeatt was holding water with a discharge of 0.9 through the combination flume with <br /> 8.OpH, 12 degrees and 3350 conductivity. The small spring discharge at East Pyeatt was <br /> discharging at 4.6 through the 1" Baski Flume with 7.6pH, 3440 conductivity and 13 degrees. <br /> TMI collected samples to be tested at each discharging location. <br /> All pond embankments were stable with no problems noted at the time of the inspection with the <br /> exception of the following. All combination spillways were in compliance at the time of the inspection. <br /> The disturbance area runoff associated with TR-103 and TR-105 reports to Horse Pond. Horse <br /> Pond's water level at the time of the inspection was approximately 2 feet below the spillway with no <br /> incoming water noted. <br /> Explosives <br /> One parting blast was conducted during the inspection. All signals were observed in compliance with <br /> the TMI permit and the TMI blasting signage. No problems were noted during the blast. <br /> Topsoil <br /> Topsoil was in the process of being removed in the Horse Gulch area in accordance with TR-103 and <br /> 105. The topsoil was placed along the ridge as approved by the Division. No problems were noted <br /> during the inspection. <br />
