<br />EXHIBIT D <br />LUSK PIT #36 <br />MINING PLAN <br />A Material will be moved by front-end loaders and trucks. A bulldozer will be used <br />in locations where loader is impractical due to loose footing. The maximum depth <br />of the mine is not expected to be more than ten (10) feet deep at any point, with the <br />north side of the mined area to be no lower than the north side of permitted area <br />(the proposed mined area is a ridge). At no point will there be a vertical cut or <br />"highwall", very little backfill will be necessary, only contouring for preparation of <br />the reclaiming process. The strata directly below is generally rock and will not be <br />disturbed. <br />B The overburden will be moved by front-end loader and bulldozer and will be <br />stockpiled for use in reclamation. <br />C There will be a water diversion berm constructed on the north side of the entrance <br />road in order to insure that no erodible material is washed onto non-permitted <br />area. No other berms for erosion control are expected to be necessary. The <br />diversion berm material will be used in reclamation and will not exist after final <br />reclamation. <br />D The area to be disturbed at any one time should not exceed twenty (20) acres. <br />After ten (10) acres are mined, five (5) acres will be reclaimed. By the time we <br />have mined a total of fifteen (15) acres, the original five (5) acres should be <br />reclaimed and we can start to reclaim another five(5) acres. <br />E 1 Mining will start when permit is received and will continue on an <br />as-needed basis. Material to be mined is primarily caliche of varying <br />depth, with up to 8 (eight) inches of topsoil overburden. <br />2 Reclamation will be an ongoing process as the site is mined. <br />3 Mining and reclamation will be continued until supply of usable material <br />is exhausted. <br />4 Active mining will move in an eastwardly direction at the site and <br />reclamation will begin in the exhausted area.
