III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Kent Gorham of the Colorado Division of <br /> Reclamation, Mining, and Safety (Division). The New Elk mine has been closed since the <br /> early 1980's and sealed since about 1989. The new operator, New Elk Coal Company LLC <br /> has plans to re-enter the underground workings for potential re-development of the Allen coal <br /> seam and possible new development of other coal resources in the immediate area Ground <br /> conditions on this day were generally dry. The weather was partly cloudy with threatening <br /> skies in the afternoon. <br /> Availability of Records <br /> The public copy of the mine records is kept at the office of Peak Project Management (PPM). <br /> The contact, address, and phone number for PPM is Ron Thompson, Peak Project <br /> Management, 34115 County Road 20.8, Trinidad, CO 81082, 719-846-4975. Records were <br /> found in compliance as detailed on page 2a of this report. <br /> Roads <br /> Roads through the site were found dry. Road drainage systems appeared functional. The <br /> access road to the RDA would benefit from grading of the inside road ditch and from the <br /> addition of surfacing material, especially in the lower%of this road. <br /> Hydrologic Balance <br /> Pond 4 at the <br /> Development Waste <br /> Pile (DWP) was <br /> effectively dry. _ <br /> Ditches at the DWP <br /> were found in good <br /> condition. Pond 7 is <br /> nearly full at will likely y <br /> require a manual - <br /> discharge in the near _ Y <br /> future. Pond 8 <br /> (shown at right) at the <br /> RDA was 6-7 feet <br /> below the lowest <br /> discharge point. The <br /> pond water volume <br /> was being pumped to <br /> Pond 6 using a gas- <br /> powered potable <br /> pump set up on the <br /> pond embankment. The five containments at this site were also found dry. <br /> 3 <br />
