III. COMMENTS - COMPLIANCE Below are comments on the inspection. The comments include discussion of observations made during the inspection. Comments also describe any enforcement actions taken during the inspection and the facts or evidence supporting the enforcement action. This was a complete inspection conducted by Kent Gorham of the Colorado Division of Reclamation, Mining, and Safety (Division). The New Elk mine has been closed since the early 1980's and sealed since about 1989. The new operator, New Elk Coal Company LLC has plans to re-enter the underground workings for potential re-development of the Allen coal seam and possible new development of other coal resources in the immediate area Ground conditions on this day were generally dry. The weather was partly cloudy with threatening skies in the afternoon. Availability of Records The public copy of the mine records is kept at the office of Peak Project Management (PPM). Records were found in compliance as detailed on page 2a of this report. Roads Roads through the site were found dry. Road drainage systems appeared functional. The access road to the RDA would benefit from grading of the inside road ditch and from the addition of surfacing material, especially in the lower%of this road. Hydrologic Balance Pond 4 at the Development Waste Pile (DWP) was effectively dry. _ Ditches at the DWP were found in good condition. Pond 7 is nearly full at will likely y require a manual - discharge in the near _ Y future. Pond 8 (shown at right) at the RDA was 6-7 feet below the lowest discharge point. The pond water volume was being pumped to Pond 6 using a gas- powered potable pump set up on the pond embankment. The five containments at this site were also found dry. 3
