Cunningham, EPS <br />Colorado Office of Mined Land Reclamation <br />1313 Sherman Street, #215 <br />Denver, Colorado 80203 <br />From: Varra Companies, Inc. <br />Bradford Janes, Professional- Forester c?O <br />Subject: M-2009-018 - Reply to the Colorado Office of Mined Land Reclamation <br />(Office) Preliminary Adequacy Review correspondence of 27 July 2009. <br />Dear Michael: <br />Please allow this correspondence to serve as our request for an extension of the Decision <br />Date from 7 October 2009 to 6 November 2009. The balance of this correspondence is to <br />provide information previously absent in our original reply of 1 September 2009. <br />A couple of follow-up items remain for our reply, as above; and as stated below. For <br />greater continuity and ease of reference, we have iterated your comments by item in a <br />graphical box, with our comments in blue following: <br />3. The Applicant submitted a copy of the `Statement of Understanding' sent to <br />owners of significant, valuable and permanent man-made structures that are located <br />within 200 feet of the affected land. A copy of the `Statement of Understanding' was <br />sent to Anadarko; however, the Division could not locate any structure(s) owned by <br />Anadarko on the Extraction Map. Please identify and label the structure owned by <br />Anadarko on all applicable maps. In addition, please locate and label all of the utility <br />structures that are within two hundred feet of the affected land, including overhead power <br />lines and buried utilities. <br />As stated in the original reply of 1 September 2009; In the process of refining the display <br />of information, DCP Midstream was found to service the lines to the Noble Energy <br />facilities outside of the permit boundary in Section 33; and with lines that are just outside <br />of, or barely within the north and south boundaries of the permit boundary. An updated <br />map reflecting this identity was previously submitted on 1 September 2009 <br />We also revised Exhibit C and sent a notice of intent to conduct mining operations, and a <br />request for a notarized signature on our Letter of Understanding for their structures to <br />DCP Midstream. Their acknowledged receipt of this information is included with this <br />reply. <br />-*"OCT 0 ? 2009 <br />
