Ill. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Kent Gorham of the Colorado Division of <br /> Reclamation, Mining, and Safety (Division) related to the termination of jurisdiction for the <br /> Trinidad Basin Mine, permit# C-81-048. This former, contour strip operation is bond revoked. <br /> All remaining funds from the bond revocation at this site were spent in 2004 for ditch repairs. <br /> The Division is in the process of terminating jurisdiction of this revoked site. As per Division <br /> policy and in accordance with Rule 3.03.3, the Division may terminate jurisdiction upon a <br /> written determination that all requirements of the Rules and the Act have been successfully <br /> completed and a final decision has been made in accordance with the bond release <br /> procedures of Rule 3.03. Ground conditions on this day were dry and the weather was cloudy <br /> with the immediate threat of rain. Landowners and County personnel were invited to attend <br /> the inspection through certified mail. No interest in attending the bond release inspection <br /> was expressed by any of the notified parties. <br /> Signs and Markers <br /> The Division had previously posted signs along the county road at the east and west permit <br /> boundaries, identifying the site as a reclaimed former coal mine. The sign at the west permit <br /> boundary was not found and has apparently been removed. <br /> General Mine Plan Compliance <br /> The reclaimed mine site is generally located in Las Animas County six miles east of the <br /> Interstate 25 Ludlow exit on County Road 44 in Del Ague Canyon. The precise description of <br /> the permit boundary is S1/2 N 1/2, S1/2 Section 15, NE11/4 NE1/4 Section 21, Section 22 <br /> (all), T31S R63W of the Sixth Principle Meridian. A coal loadout was located in a portion of <br /> Section 15, T33S R63W of the Sixth Principle Meridian in the town of Trinidad, Colorado. <br /> Another rail loadout was planned and/or operated on the west side of the railroad <br /> immediately southwest of the Ludlow Massacre site. <br /> The inspection began at the site of a <br /> planned loadout at the intersection of <br /> County Roads 61.5 and 44.0, <br /> immediately southwest of the Ludlow <br /> Memorial. As shown at right, the <br /> loadout was planned on the far side of <br /> the railroad tracks and/or in the pasture <br /> with the windmill adjacent to the tracks. <br /> A siding about 75 feet wide and 600 feet <br /> long is located on the southwest side of <br /> the railroad tracks. First impressions <br /> seemed to indicate it may have been <br /> used to stockpile coal or coal product at <br /> some point in the past.
