Ill. COMMENTS - COMPLIANCE <br /> Eagle Mines C-1981-044 <br /> 17 Sept 2009 <br /> Pg 1/2 <br /> Below are comments on the inspection. The comments include discussion of observations <br /> made during the inspection. Comments also describe any enforcement actions taken <br /> during the inspection and the facts or evidence supporting the enforcement action. <br /> This was a complete inspection of the Eagle Mines conducted by Jim Stark of <br /> CDRMS. Jerry Nettleton of BTU-Empire accompanied me on the inspection. The <br /> mine is currently in temporary cessation and is only performing maintenance and <br /> monitoring activities. The inspection was conducted on the afternoon of 17 <br /> September 2009. The weather was warm and sunny and the ground was dry. <br /> Availability of Records: All of the necessary records were available. The records were <br /> brought to the inspection in three-ring binders by Jerry Nettleton (they are stored at <br /> the Foidel Creek Mine in Oak Creek, CO). Please see the DBMS Availability of <br /> Records form at the end of this inspection for more detailed information. <br /> Signs and Markers: - All of the necessary signs were in place as required. The <br /> entrances along the west and east of Colorado Highway 13 all have the appropriate <br /> signs. Stream buffer zone (and buffer zone exemption) signs were also in place as <br /> required. All of the topsoil piles inspected had the proper signage as did the <br /> disturbed boundary. The Division completed the annual AVS check at the entrance <br /> sign and with the operator. All of the correct Information was on the mine ID sign <br /> (mine operator: BTUEC; Mine permittee: BTUEC; permit number: C-1981-044; and <br /> MSHA ID number: 05-1370). <br /> Roads: - The mine access road is a gravel road. It was dry and well maintained. <br /> There were no ruts or erosional problems noted with the road. <br /> - The access roads on the east side of the mine were all dry and well maintained at <br /> the time of the inspection. There were no ruts or erosional problems noted on these <br /> reads. <br /> Hydrologic Balance: - The Mine 5 dewatering ponds, 5-P5, 5-P6 and 5-P7, all <br /> contained water and were all stable and well vegetated at the time of the <br /> inspection. The ponds were discharging what looked to be about 5 gpm into the <br /> Williams Fork River at the time of the inspection (from the outfall from Pond 5-P7). <br /> - Sediment Ponds 5-P1 and 5-P2, just north of the warehouse/shop building, were <br /> both dry at the time of the inspection. The pond embankments were well vegetated <br /> and no erosional problems were noted. <br /> - Sediment Pond 9-P2 was dry at the time of the inspection. This pond is on the east <br /> side of the mine. The pond embankment was well vegetated and no erosional <br /> problems were noted. <br />
