M. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection of the Munger Canyon Mine conducted by Mike Boulay of the DRMS <br /> Grand Junction Field Office on September 23, 2009. Rodney Head the Safety Director for McClane <br /> Canyon Mining LLC (MCM) was present during the entire inspection. Weather conditions were sunny <br /> and cool and ground conditions were dry. The majority of the mine site is reclaimed and there was no <br /> activity at the site during this inspection. <br /> Availability of Records <br /> The availability of records was checked at the Munger Mine office on September 23rd. A current <br /> Insurance Certificate was identified as missing from the records file. Please update the records with <br /> the current Insurance Certificate for the Munger Canyon Mine. All other required records were on-site <br /> and available for review (see the DRMS Availability of Records checklist at the end of this inspection <br /> report). <br /> Roads <br /> The access road to the mine site was dry and the road was generally in good condition. No problems <br /> were noted along its entire length up to the former portal bench access road. <br /> Hydrologic Balance <br /> East Salt Creek had very little water and Munger Creek was only damp in some shaded areas. Ditches <br /> and culverts associated with the reclaimed waste disposal site cover soil stockpile site, and the topsoil <br /> stockpile locations were in good condition and maintained. The waste disposal area sediment pond <br /> was dry. The inlet and discharge structures were stable and no problems were noted at these locations. <br /> The entire reclaimed portal access road was inspected up to the mine bench area. Overall the <br /> reclamation looks very good and there has been minimal erosion since the reclamation was completed <br /> in 2007. All of the permanent drainage channels have held up very well and appear to be functioning <br /> adequately. <br /> Backfill and Grading <br /> Backfilled slopes along the length of the portal access have held up well and no signs of significant <br /> erosion or instability were noted during this inspection. An important part of this inspection was to <br /> view the portal backfill repair that was completed on September 18, 2009. A crack and slump had <br /> opened at one of the portal entries on the mine bench area and this was identified and documented <br /> during the Phase I bond release inspection conducted on 12/03/08.
