III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> Support Facilities <br /> The entire South Portal reclaimed area remains stable and in good condition. The Kokopelli fruit stand <br /> was open for business at the time of the inspection. The location of the South Portal drainage pipe <br /> repair remains sealed and no problems noted. The backfilled South Portal is dry and stable, vegetation <br /> is well established on the reclaimed slope and no there were no signs of erosion or instability(see <br /> attached Photograph No. 3). <br /> At the UTL loop area, Halliburton was not actively loading trucks with sand at the time of the <br /> inspection. Representatives of XCEL Energy were at the UTL viewing the site in preparation for <br /> bringing power to the site for the Halliburton facility. There was no other activity at the site. No <br /> problems were noted at any of the mine site locations during this inspection. <br /> Fish&Wildlife <br /> The site of the Cooper's Hawk Nest identified and reported by WestWater Engineering for the <br /> Halliburton-Cameo Storage Yard was inspected. The nest is located in a grove of cottonwoods at the <br /> east side of the UTL. There were no signs of activity at the nest. The nest remains in good condition <br /> (see Photograph No. 4). <br />
