III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a complete inspection of the Roadside Portals Mine conducted on September 22, 2009 by <br /> Mike Boulay of the Division of Reclamation, Mining and Safety Grand Junction Field Office. Tonya <br /> Hammond of Snowcap Coal Company(SCC) was present during the inspection. Weather conditions <br /> were sunny and warm. Ground conditions were dry. <br /> Availability of Records <br /> The availability of records was checked on September 22. All required records were on file and <br /> available for review at J.E. Stover&Associates offices. No problems were noted with the records <br /> review. See the attached Availability of Records checklist. <br /> Roads <br /> Roads were dry and well maintained. Road ditches were in good condition and road culverts were all <br /> generally well maintained throughout the various mine site locations and support facility areas. <br /> Hydrologic Balance <br /> All site Sedimentation Ponds including UTL-1 & 2, 6, 7,8,9,10,11, and 13 were inspected. Sediment <br /> Pond No.2 at the UTL was damp and all other site sedimentation ponds were dry. The sedimentation <br /> ponds are well maintained and capable of functioning as intended. All pond embankments, inlets and <br /> discharge structures were stable and no problems were noted at any of the sediment pond locations. <br /> Drainage and diversion ditches were stable with no significant erosion or other problems noted. All of <br /> the drainages and diversion ditches were dry, with exception of the North Collection Ditch at the South <br /> Portals area which usually has a small amount of water flowing in it that originates from the South <br /> Portals French Drain. <br /> The North Portal clean water diversion ditches including the West Diversion Ditch and East Diversion <br /> Ditch were inspected along the entire length(see attached Photograph No's 1 and 2). The diversion <br /> ditches are in very good condition with only minor erosion occurring in a small section of the East <br /> Diversion. This does present any problems because the erosion that has occurred is now down to <br /> competent rock and the ditch is very stable. <br />
