Cattany <br />Division Director <br />Natural Resource Trustee <br />On 26 August 2009, the Division of Reclamation, Mining and Safe "Division" received the <br />application for T -9, which you prepared on behalf of Western Fuels - Colorado LLC (AFC). <br />The application was determined to be Complete for purposes of filing on the 2nd of September. <br />The Public Notice appeared in the San Miguel Basin Foy on the 4h of September. Proof of <br />that publication has not yet been provided. <br />T - 9 seeks to modify the surface water monitoring plan for the New Horizon Thine near the <br />town of lucla in western Montrose County. The Division has reviewed the application for T.- <br />9; our comments are provided below and in the attached memo prepared by Mike Boulay. <br />1, In the currently approved permit application package, groundwater wells and surface <br />water sampling points are represented on Map 2.04.7 -1A — Hydrologic Monitoring Site <br />Location Map with Domestic Wells. The map scale is approximately 1" = 50 feet. This <br />neap was last updated with T -4, approved on 30 July 2007. Surface water sampling <br />points SW-N2 and SW -N3 are outside of the mapped area.. Please r r i , Map Z 04.7- <br />1 to accurately illustrate the locations of these two points and extend the courses o <br />Tuttle Draw and Enstrom Draw accordingly. Please use a color plotter so that the <br />various line types and features can be easily discerned. <br />2. The surface grater data provided in Attachment 1 of the T - 9 application appears to <br />contain some inconsistencies when compared with Annual Hydrology Reports submitted <br />by WFC . <br />SW -N1 Pre Hine 1s missing are entry for 22-Oct-82. <br />* SW-NI Post Mine T S results are listed under March./September rather than <br />February /August <br />Office of office of <br />Mined Land Declamation Denver * G rand junction • Durango Active and Inactive Mines <br />
