Cattany <br />Les Ewegen LLC Division Director <br />WCR 39 Natural Resource Trustee <br />Eaton, CO 80615 <br />Subject: Amendment Application AM-04 for 120th Estates Partners, 120th Estates Pit <br />Adams County, File M-2001-085, Incompleteness Notice ° <br />Dear Mr. Ewegen: <br />The Division of Reclamation, Mining, & Safety (Division) received your application for <br />Amendment AM-04 on 23 September 2009. Unfortunately the application is incomplete. Rule <br />1.10.1(4) states that applications for amendments shall be reviewed by the Division in the same <br />manner as applications for new Permits. Therefore, the applicant must provide the following <br />information before the application may be designated as complete and filed: <br />Rule 1.6.2 - General Application Procedures: In accordance with Rule 1.6.2(1)(a), the <br />applicant must, prior to submitting the application to the Office, send a notice to the local Board <br />of County Commissioners, and if the mining operation is within the boundaries of a soil <br />conservation district, to the Board of Supervisors of the soil conservation district. Please provide <br />proof that the above notices were sent. Proof of notice must be in one of the formats described in <br />Rule 1.6.2(1)(a)(ii). The local conservation district is the West Adams Conservation District, 224 <br />S. 14th Avenue, Brighton, CO 80601. <br />In accordance with Rule 1.6.2(1)(b), prior to submitting the application to the Office, applicant <br />must post notices (signs) at the location of the proposed mine site, of sufficient size and number <br />to clearly identify the site as the location of a proposed mining operation. Please provide a <br />signed affidavit that such notice (sign) was posted according to the provisions of Rule <br />1.6.2(1)(b). Please also include sufficient photographs to show the location(s) of the sign(s). <br />In accordance with Rule 1.6.2(1)(c), prior to submitting the application to the Office, applicant <br />must place for public review a copy of the application with the Adams County Clerk or <br />Recorder, and provide proof as required by Rule 6.4.18. <br />Rule 6.4.1, Exhibit A - Legal Description and Location Map: Please update as needed or <br />indicate where in previous documentation the information may be found. <br />Rule 6.4.2, Exhibit B - Site Description: Please update as needed or indicate where in <br />previous documentation the information may be found. <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
