III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a complete coal inspection conducted by Jason Musick of the Colorado Division of <br /> Reclamation, Mining, and Safety(Division) on 14 September 2009. The weather was clear and the <br /> ground was dry during the on-the-ground inspection of the site. <br /> Availability of Records <br /> See attached DRMS Availability of Records. All records were located at the Routt County Courthouse <br /> in Steamboat Springs, CO. <br /> Signs and Markers <br /> The mine I.D. signs were in place at the entrance of the Old Tipple Road entering the mine area to the <br /> south, the road off of County Road 79 and the North Road entering the mine area from the north. All <br /> mine I.D. signs were in compliance with no problems noted at the time of the inspection. <br /> Roads <br /> The Old Tipple Road, North Road, Lower Moffat Road, Center Ridge Pond Road, West Ridge Pond <br /> Road, and West Ridge were dry and stable at the time of the inspection. Roadside ditches were in <br /> good condition and stable with no problems noted. <br /> Hydrologic Balance <br /> The Moffat Pond was holding clear water with a light trickle discharge noted. The embankments were <br /> stable and well vegetated with no problems noted. The primary spillway was functioning as permitted <br /> and the emergency spillway was in compliance with no evidence of damage and no problems noted. <br /> The Center Ridge pond was holding water and discharging at the time of the inspection. The <br /> embankments appeared stable and in compliance at the time of the inspection the primary spillway <br /> was functioning as permitted and the emergency spillway was in good condition with no problems <br /> noted. <br /> The West Ridge Pond was holding water with no discharge noted at the time of the inspection. The <br /> lower cell of the West Ridge Pond was dry at the time of the inspection. The embankments were <br /> stable and well vegetated with no problems noted. The primary and emergency spillways were in <br /> good condition with no problems noted. <br /> Technical Revision 48 approved the removal of water monitoring at the Edna Mine. Wells WR-1 and <br /> TR-1.5 have been plugged and abandoned. The sites have been marked and no problems were <br /> noted with the reclamation of the sites. <br />
