Ill. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a complete coal inspection conducted by Jason Musick of the Colorado Division of <br /> Reclamation, Mining, and Safety(Division) on 15 September 2009. The weather was cloudy with rain <br /> towards the end of the inspection and the ground was wet during the inspection of the site. Forrest <br /> Luke of TMI accompanied the inspection. <br /> Trapper continues to progress with mining in the F-Pit and Z-Pit. Activity in Horse gulch is <br /> progressing as permitted under TR-103. The small area of D-Pit is being utilized for the newly <br /> acquired truck/loader fleet. <br /> Availabilitv of Records <br /> See attached DRMS Availability of Records. All records were inspected at the Trapper Mine site. <br /> Signs and Markers <br /> Mine ID and Blasting signs were displayed in the locations required. All required information was <br /> properly displayed at the time of the inspection. Topsoil markers and Permit Boundary markers <br /> inspected are delineated with a piece of PVC pipe attached to a T-post with either a P for permit <br /> boundary or T for topsoil. The topsoil markers and permit boundary markers observed were in good <br /> condition and displayed in the appropriate locations. All signs and markers were in compliance with <br /> Rules 4.02.2, 4.02.6(3) and 4.02.7 at the time of the inspection. <br /> Roads <br /> All haul roads were wet at the time of the inspection. All haul road side ditches were functioning as <br /> permitted at the time of the inspection. Adequate runoff was noted with no signs of damage or <br /> erosion. Access roads were dry with full access. All access roads appeared to be stable with no <br /> damage noted. Pond access roads appeared to have been recently graded and provide good runoff. <br /> Road culverts observed were functioning as permitted with no problems noted. <br /> Hydrologic Balance <br /> Discharging ponds were being monitored by Forrest Luke of TMI during this inspection. Two ponds <br /> were discharging during the inspection. <br /> • No Name appeared stable with no problems noted. No Name contained water and had a <br /> discharge rate of .27 a pH of 8.4 at 15.3 degrees and 2040 conductivity. <br /> • Johnson contained water with discharge at .04 and pH at 8.4 and 4340 conductivity. <br /> East Pyeatt, Oak, Middle Flume, East Flume, Horse and Deal ponds contained water with no <br /> discharge at the time of the inspection. All pond embankments were stable with no problems noted at <br /> the time of the inspection with the exception of the following. All combination spillways were in <br /> compliance at the time of the inspection. <br /> Middle Flume pond was being prepared for cleanout at the time of the inspection. <br />
