III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a complete coal inspection conducted by Jason Musick of the Colorado Division of <br /> Reclamation, Mining, and Safety(Division) on 16 September 2009. The weather was clear and the <br /> mine site was wet during the on-the-ground inspection of the site. Scott Wanstedt of BME <br /> accompanied the inspection. This was a OSMRE complete oversight inspection with a focus on <br /> Signs and Markers under Rule 4.02. Christine Belka of OSMRE accompanied the inspection <br /> The mine is currently operating as permitted. No drilling activities were in progress during the <br /> inspection. Deserado Mine continues to longwall in panel 10. Coal was in the process of being <br /> loaded into the electric train to be transported. <br /> Availability of Records <br /> See attached DRMS Availability of Records. All records were inspected at the Deserado Mine site <br /> office. <br /> Signs and Markers <br /> All mine ID signs required were in place at the time of the inspection. Mine ID signs were located at <br /> the intersection of State Highway 64 and Rio Blanco County Road 65, the permit boundary on CR 65, <br /> the permit boundary at CR 96 and five locations where the permit boundary crosses CR 73. The <br /> mine ID signs include the name of the permittee, the name of the operator, the address of the <br /> operator, the identification number of the operator and the MSHA ID number of the operator. <br /> Topsoil and subsoil markers were in place at the required locations. These areas are delineated with <br /> a PVC post with a sticker noting either topsoil or subsoil. <br /> Roads <br /> The paved Deserado Mine Road was well maintained and in good condition. The haul road from the <br /> facilities area to the refuse disposal area was wet and stable and displayed good drainage with no <br /> problems noted. The conveyor corridor road, access roads and light-use roads were in good <br /> condition with no problems noted. All roadside ditches and diversions were functioning and stable at <br /> the time of the inspection. <br /> Hydrologic Balance <br /> The DP-1 Pond contained a small amount of water with no discharge noted. The pond embankments <br /> were stable and well vegetated. The primary spillway is stable with no problems noted. A walkway <br /> will be installed to aid in the sampling when discharge occurs. The emergency spillway has been <br /> updated to include a concrete barrier to the approved height of the spillway. <br />
