III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during <br /> the inspection. Comments also describe any enforcement actions taken during the inspection and the <br /> facts or evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Janet Binns of Colorado Division of Reclamation, Mining <br /> and Safety. Joe Shoemaker of Twentymile Coal Company accompanied the field portion of the <br /> inspection. The Foidel Creek Mine is a large active underground mine. The weather was warm and dry <br /> during the inspection. The operation is mining NMD longwall panel 24. TCC is mining one shift. The <br /> day shift at the time of the inspection was conducting maintenance. <br /> Records: The Annual AVS inspection was conducted. The operator confirmed that Twentymile Coal <br /> Company remains both the permittee and the operator. The MSHA number remains unchanged. <br /> Roads: Haul Roads and access roads throughout the mine are in good condition. TCC has cleaned and <br /> shaped many of the ditches throughout the facilities area. Ditches around facilities area are functional <br /> and no ditch or drainage failures of the structures were observed around the facilities area. The water <br /> truck was observed watering road Haul Road A at the time of the inspection. <br /> Hydrologic Balance: TCC was not pumping from 1 ORT at the time of the inspection. The CPDS permit <br /> for the IORT discharge is COG-850048, which expired 9/l/2009. TCC will need to obtain a discharge <br /> permit from the CPDHE prior to any renewed discharge from this site. TCC personnel were installing <br /> piping to the 1 ORT pumping system at the time of this inspection. The old pumphouse has been <br /> dismantled, but the new pumphouse has yet to be constructed. TCC continues to investigate a long term <br /> solution to water treatment from the I ORT borehole. A revision should be forthcoming for 1 ORT <br /> treatment system. <br /> 6MN reservoir continues to hold a shallow pool of water. This pool is from spring runoff and <br /> precipitation. No pumping into the reservoir has occurred. TCC has not yet installed the pumping <br /> facilities at the 6MN reservoir. Once piping and pump installation is complete the As-built certification <br /> will be prepared. This certification will need to be provided to DRMS and on file at the mine. <br /> Stabilization seeding is needed on the outslopes of the 6MN reservoir. <br /> 6MN sediment pond has been approved be a discharging pond with the installation of a spillway. The <br /> Division has proposed the approval of this revision, TR57. The public notice ran in the Steamboat Pilot <br /> on 9/6/2009. The close of business on 9/16/2009 will be the close of the public comment period. TCC <br /> had not initiated any work to the 6MN sediment pond prior to the final approval. <br /> Ponds inspected included Pond B and 6MN pond. Water was being pumped from Pit 1 to Pond D. . <br /> The water level in Pond B was well below the discharge elevation (-8" below). The oil booms at the <br /> weir need to be replaced, but oil booms in the pond appear fairly new. The Pond B ramp area has been <br /> shaped up. The culvert from the north sump to the south sump has been reset and was flowing well. <br /> Water from the south sump is flowing into Pond B. Wash down water off Haul Road C is flowing <br /> appropriately into the sumps. Truck Loadout has been graded and ditches shaped. TCC has placed two <br /> rock filters in the ditch prior to an armored berm cut that will allow drainage to run into Pond C. The <br /> black hose has been anchored and extended to minimize gullying of the slope. This configuration should <br /> help minimize excessive flow to the Pond B area, and direct it to Pond C as designed. <br /> 3 of 6 WHITE-File YELLOW-Operator PINK-Specialist <br />
